چکیده
تفکیک بین اعمال مدنی و تجاری و شناسایی فعالیتها و معاملات تجاری از دیرباز منشأ آثار بسیاری بوده که به تدریج در اغلب نظامهای حقوقی بهصورت مدون و در قالب قوانین تجاری مورد پذیرش قرار گرفته است. کتاب حقوق تجارت جلد اول در بیان مقدمات حقوق تجارت و با تمرکز برحقوق و تکالیف بازرگانان و شناسایی اعمال تجاری برای دوره کارشناسی حقوق، منطبق با قانون تجارت ایران تدوین شده است. نقد کتاب حاضر با استفاده از معیارها و مشخصههای شناخته شده، به منظور ارزیابی اثر و مآلاً شناسایی نقاط ضعف و قوت آن در جهت ارتقا و بهبود پژوهش انجام شده است. از مهمترین نواقص کتاب، میتوان به فقدان جامعیت محتوایی و تا حدودی ضعف مباحث تحلیلی اشاره نمود که علل تدوین اثر را تحت شعاع خود قرار داده است. از آنجا که کتاب مورد بررسی، یکی از کتب دانشگاهی است، ضرورت تکمیل و ارتقاء آن قطعاً هم برای نویسنده و هم برای دانشجویان مفید خواهد بود. امید است در چاپهای بعدی برخی ایرادات رفع گردد.متن
Commercial Law Book Review (Volume I / Merchants and Commercial Acts)
The distinction between civil and commercial practices and the identification of commercial activities and transactions have long been the source of many effects that have gradually been accepted in most legal systems in a codified form and also in the form of commercial laws. The book of Commercial Law, Volume ۱ has been compiled in accordance with the Iranian Commercial Code, stating the basics of commercial law and focusing on the rights and duties of businessmen and identifying commercial practices for the undergraduate law course. The critique of the present book has been done using the known criteria and characteristics in order to evaluate the book and to identify its strengths and weaknesses in order to promote and improve the research. One of the most important shortcomings of the book is the lack of comprehensiveness of content and the weakness of analytical discussions, which has overshadowed the reasons for compiling the work. Since the book in question is one of the academic books, the need to complete and upgrade it will definitely be useful for both the author and the students. It is hoped that some issues will be modified in future editions.
