مقایسه حمایت از بزه دیده در حقوق ایران و اسناد بین المللی

چکیده
بحث حمایت از بزه دیده یکی از مهمترین مباحث حقوق جزاء و جرم شناسی می باشد زیرا جرم پدیده ای است که عمدتا در ارتباط بزهکار و بزه دیده به وجود می آید و ارتباطی لازم و ملزمی در میان آنها حکمفرما می باشد بگونه ای که بدون بزهکار جرمی وجود ندارد و بدون بزه نیز بزهکاری ایجاد نخواهد شد. از این رو مقاله حاضر حمایت از بزه دیده در حقوق کیفری ایران و اسناد بین المللی را با بهره گیری از، روش تحقیق، مقایسه ای و شیوه ی گردآوری اطلاعات، کتابخانه ای مورد مطالعه و پژوهش قرار داده است سوال مطرح شده در مقاله این بوده است که چه نقاط اشتراک و افتراقی در حمایت از بزه دیده در حقوق ایران و اسناد بین المللی وجود دارد؟ یافته های مقاله حکایت از آن دارد که در حقوق ایران توجه بیشتر محققین به شناسایی بزه دیده بوده است و توجه کمتری به حقوق آن براساس اسناد بین المللی گردیده و اگرچه سیاست جنایی ایران و اسناد بین المللی در برخی از زمینه ها به یکدیگر مشابه است، اما تفاوت در شرایط اجتماعی و داخلی ایران با حوزه حقوق بشر بین الملل باعث می شود تا زمینه رشد و توجه به بزه دیده در کشور ایران عقب تر باشدComparison of Victim Protection in Iranian Law and International Documents
The topic of protecting the victim is one of the most important topics in criminal law and criminology because crime is a phenomenon that mainly occurs in the relationship between the offender and the victim, and there is a necessary and binding relationship between them in such a way that there is no crime without the offender and no offense without the offender. Therefore, this article has studied and researched victim protection in Iran's criminal law and international documents by using the comparative research method and the method of information collection, a library. The findings of the article indicate that in Iranian law, researchers have paid more attention to the identification of the victim, and less attention has been paid to its rights based on international documents, and although Iran's criminal policy and international documents are similar in some areas, the difference in Iran's social and internal conditions with the field of international human rights makes the field of development and attention to the victim in Iran lag behind.
