چکیده
حقوق بشر یکی از ارکان نظام حقوقی بین الملل شناخته می شود. رعایت این حق تأثیر مستقیمی در وضع سایر حقوق در صحنه بین المللی دارد. موضوع رعایت حقوق بشر دغدغه بسیاری از مردم جهان است. امروزه حق داشتن محیط زیست سالم در زمره حقوق بشر تلقی می شود، زیرا بدون داشتن محیطی سالم امکان بقا وجود ندارد. همچنین بدون محیط زیست سالم موضوع صلح و امنیت بین المللی دچار بحران های اساسی خواهد شد. امروزه شاهد آن هستیم که بسیاری از کشورها با تخلفات زیست محیطی کره زمین را با مشکل مواجه می کنند. باتوجه به این موضوع که بحران های زیست محیطی در محدوده مرزها محصور نمی شود و می تواند با سرعت بر سایر کشورها اثر بگذارد نمی توان بحران محیط زیست را صرفاً در حوزه قلمرو حاکمیت ها دید و ایجاد بحران توسط یک متخلف می تواند بعنوان نقض حقوق بشر جمعی تلقی شود، همچنین در وضعیت جنگ و نزاع نیز حقوق بین الملل بشردوستانه به موضوع محیط زیست و حفظ آن توجه کرده است، در شرایطی که بسیاری از الزامات دستخوش شرایط سخت نظامی قرار می گیرد این حقوق می خواهد از برخی خطوط قرمز مثل محیط زیست حفاظت نماید به همین دلیل این سوال مطرح می شود که موضوعات زیست محیطی و توجه به آن در حقوق بشر و حقوق بین الملل بشردوستانه چگونه است بر این اساس در این پژوهش بحران های زیست محیطی و جایگاه آن در حقوق بشر و حقوق بین الملل بشردوستانه با روش توصیفی تحلیلی مطالعه شده است. نتایج نشان می دهد که توجه به حقوق پایه و بنیادین بشر بر لزوم حفاظت از محیط زیست تأکید دارد اما به دلیل تخلف دولت ها و عدم ضمانت اجرایی قوی این مهم محقق نمی شودThe Position of the Environment in Human Rights and Humanitarian Rights to Control Risks

The formation of environmental crises is not confined within borders and can quickly affect other countries, for this reason, environmental crisis cannot be seen only in the domain of sovereigns, and the creation of a crisis by an offender can be seen as Violation of human rights is considered collective, also in the situation of war and conflict, international humanitarian law has paid attention to the issue of the environment and its preservation, in a situation where many requirements are subjected to harsh military conditions, these rights require some lines Red is like protecting the environment, for this reason, the question arises as to how the environmental issues and attention to them are in human rights and international humanitarian law. Accordingly, in this research, environmental crises and their place in human rights and International humanitarian law has been studied with a descriptive and analytical method. The results show that paying attention to basic and fundamental human rights emphasizes the need to protect the environment, but due to the violations of the governments and the lack of strong executive guarantees, this is not achieved
