بررسی حقوقی قراردادهای هوشمند در حوزه نفت و گاز و پتروشیمی

چکیده
معرفی زنجیره های تأمین هوشمند یکی از گام های اساسی و مهم درخصوص حوزه نفت، گاز و پتروشیمی در شرایط تحریمی کنونی است. از طرفی به دلیل پیچیدگی بالای مدیریت زنجیره تأمین نفت و گاز و پراکندگی جغرافیایی بسیار بالای این حوزه و ویژگی های پیشرفته ای مانند مدیریت داده محور، اشتراک گذاری اطلاعات، حفظ محرمانگی و حریم خصوصی داده ها، امنیت سایبری، شفافیت، قراردادهای هوشمند، قابلیت رهگیری و ردیابی و قابلیت اطمینان شبکه که چابکی را در کل زنجیره تأمین ارتقاء می دهد از اهمیت خاصی برخوردارند. هدف اصلی مقاله حاضر مطالعه تأثیرات، نحوه پیاده سازی و تأثیرات استقرار سیستم قراردادهای هوشمند به عملکرد حوزه نفت، گاز و پتروشیمی است. لذا تلاش گردیده است با مروری نظام مند به ابعاد، زوایا و تأثیرات این حوزه پرداخته شود. روش پژوهش مقاله پیش رو بصورت تجویزی بوده و نویسنده با انجام پژوهش های کتابخانه ای پیرامون چالش های سیاست گذاری انعقاد قراردادهای هوشمند در حوزه صنایع نفت، گاز و پتروشیمی سعی در تجویز پیاده سازی سازوکارهای انعقاد یکی از نوین ترین ابزارهای الکترونیکی کاربردی در این حوزه نموده است. یافته ها نشان می دهد که استفاده از قراردادهای هوشمند موجب کاهش بروکراسی های اداری فعلی، بهبود سرعت، دقت و کارایی عملکرد کل زنجیره تأمین حوزه نفت و گاز گردیده و می تواند نقش موثر و بسزایی در مدیریت فعالیت های پیچیده این حوزه نماید. همچنین در راستای استقرار این سامانه ها برخی محدودیت های فنی، امنیتی و قانونی وجود دارد که می بایست با دقت بیشتری مورد بررسی قرار گرفته و سایر جنبه ها نیز این قراردادها منطبق با حقوق اساسی کشورمان مورد تدقیق و بررسی های بیشتری قرار گیرندLegal Review of Smart Contracts in the Field of Oil and Gas and Petrochemicals

The main purpose of this article is to study the effects, the way of implementation and the effects of establishing the smart contracts system on the performance of the oil, gas and petrochemical fields. Therefore, it has been tried to deal with the dimensions, angles and effects of this field with a systematic review. The research method of the previous article is prescriptive and the author, by conducting library research on the policy challenges of concluding smart contracts in the field of oil, gas and petrochemical industries, tried to prescribe the implementation of the mechanisms of conclusion of one of the newest electronic tools. applied in this field. The findings show that the use of smart contracts has reduced the current administrative bureaucracies, improved the speed, accuracy and efficiency of the entire supply chain of the oil and gas field and can play an effective and significant role in managing the complex activities of this field. . Also, in line with the establishment of these systems, there are some technical, security and legal restrictions that should be examined more carefully and other aspects of these contracts in accordance with the constitutional rights of our country should be checked and examined more. be placed.
