چکیده
در مواجهه با جرایم ارتکابی و تضییع حقوق اشخاص و همچنین نقض نظم و امنیت جامعه، نخستین جایی که مراجعه به آن به ذهن اشخاص خطور می نماید، نیروی انتظامی و پلیس است؛ نهاد پلیس دارای وظایف و اختیارات گسترده ای است؛ که یکی از این وظایف در ارتباط با دادرسی های کیفری و همچنین کشف جرم می باشد که در راستای آن بایستی پلیس و سایر ضابطین، حقوق مظنون و متهم را رعایت نمایند. نظام دادرسی اسلامی که بر پایه اصل کرامت و حرمت انسانی بنا شده است به عنوان نظامی مستقل در کنار دیگر نظام های دادرسی متضمن اصولی است که حقوق متهم را در حد اعلایش تضمین می کند. در این پژوهش با استفاده از روش تحقیق توصیفی- تحلیلی به مقتضیات و پیامدهای تضمین حقوق مظنونان و متهمان در مرحله تحقیقات پلیسی با نیم نگاهی به فقه و حقوق ایران پرداخته شده است. یافتهها نشان داد که نهادینه سازی نظام آموزش کثرتگرایی فرهنگی به مأموران پلیسی، افزایش دامنه آگاهی مظنونان و متهمان از حقوق دفاعی و افزایش دامنه نظارت بر فرایند تحقیقات پلیسی از جمله مقتضیات و همچنین محکومیت مظنونان و متهمان بیگناه و بی اعتمادی به سامانه دادگری جنایی از جمله پیامدهای ناشی از عدم رعایت حقوق مظنونان و متهمان در مرحله تحقیقات پلیسی خواهد شدPrerequisite of guaranteeing and consequences of not guaranteeing the rights of suspects and defendants in the police investigation stage with a jurisprudential and legal approach
In the face of crimes committed and the violation of the rights of individuals, as well as violations of public order and security, the first place that comes to mind is the police and the police; The police force has a wide range of duties and powers; One of these duties is related to criminal proceedings and crime detection, in which the police and other officers must respect the rights of the suspect and the accused. The Islamic judicial system, which is based on the principle of human dignity, as an independent system, along with other judicial systems, includes principles that guarantee the rights of the accused to the highest degree. In this research, using the descriptive-analytical research method, the requirements and consequences of guaranteeing the rights of suspects and defendants in the police investigation stage are discussed with a look at Iranian jurisprudence and law. The findings showed that the institutionalization of the cultural pluralism education system for police officers, increasing the scope of suspects and defendants' awareness of defense rights and increasing the scope of monitoring the police investigation process, as well as the conviction of innocent suspects and defendants and distrust of the criminal justice system.
