چکیده
هدف این نوشتار مفهوم شناسی دقیق اصطلاحات مربوط به مرحله نظارت بر آرا است، رویکرد این اهتمام تفکیک قانونی و اعمال صحیح آن در اسناد حقوقی است. روش پژوهش به شیوه کتابخانه ای مبتنی بر تحلیل اصولی و حقوقی است. نظارت قضایى در مفهوم وسیع آن، مؤثرترین روش تضمین رعایت سلسله مراتب میان منابع حقوق و مراجع وضع قاعده حقوقى است. از مهمترین مصداقهای نظارت بر آرای قضاوتی به مفهوم اعم نظارت، شیوه های اعتراض، ایراد، شکایت و تجدیدنظرخواهی، فرجام خواهی، واخواهی و اعاده دادرسی است. در معنای عام نظارت قضایی بر آرا در برگیرنده نظارت مقام قضایی بر آرای مراجع دادگستری و غیردادگستری است؛ اما «نظارت قضایی در مفهوم خاص»، صرفاً نظارت مرجع قضایی بر آرای مراجع اداری )غیردادگستری( است؛ مانند نظارت دیوان عدالت اداری که به عنوان مرجع قضایی اداری به اعتراضات مراجع اداری رسیدگی میکند. نظارت بر آرای داوری نیز چنانچه به وسیله مراجع قضایی صورت پذیرد، مصداقی از نظارت قضایی به مفهوم خاص به شمار می رود؛ زیرا داوری مرجعی غیردادگستری است.Cognitive Conceptual Analysis of Monitoring Judicial Verdicts
The purpose of this paper is to provide an accurate semantics of the terms related to the vote monitoring stage, the approach of this effort is legal separation and its correct application in legal documents. Supervision of arbitral awards, if carried out by judicial authorities, is an example of judicial supervision in a special sense; because arbitration is an unjust reference.
