چکیده
در این مقاله علتهای قانونی-قضایی فساد از نظر خبرگان مورد شناسایی قرار گرفته است و به ارزیابی وضعیت اقدامات و راهبردهای قانونی-قضایی در مقابله با فساد و اهمیت این راهبرد در مقایسه با سایر راهبردهای مبارزه با فساد، و وضعیت و اهمیت (وزن) شاخصهای راهبرد قانونی- قضایی برای مبارزه با فساد از نظر خبرگان (ناظران برون سازمانی، ناظران درون سازمانها، استادان متخصص دانشگاه) پرداخته میشود. روش اصلی این پژوهش، پیمایشی است که مبتنی بر یکی از شاخههای آن به نام روش دلفی یا نظرسنجی از خبرگان، انجام شده است. یافتهها نشان میدهد علتهای قانونی- قضایی فساد در رتبه اول، و شاخصهای عدم رسیدگی به شکایات و برخورد با مفسدان، ضعف قوانین، مهمترین علت قانونی- قضایی بروز و گسترش فساد است. همچنین نمره وضعیت موجود راهبرد قانونی- قضایی مقابله با فساد در کشور از میانگین کمتر، و نسبتا ضعیف است؛ اما اهمیت این راهبرد برای مقابله با فساد در کشور از نظر خبرگان نسبتاً زیاد است.Investigating Legal-Judicial Causes of Corruption and Evaluation of Legal-Judicial Strategies in Anti-Corruption
in this article, the legal-judicial causes of corruption according to experts have been identified and the status of legal-judicial strategies and anti-corruption actionsand their importance compared to other anti-corruption strategies, and also the status and importance (weight) of legal-judicial anti-corruption indicators have been examined according to experts (externalobservers, observers within organizations and universityexperts). The main method employed in this study is an observational one which is based on a technique called the Delphi technique, in which experts judgments are surveyed. The findings showthat among the most important causes of incidence and spread ofcorruption the legal-judicial causes of corruption rank first and then the indicators of complaints about ignoring and dealing with corrupt individuals, weak legislation rank second. Additionally, the current status of the legal-judicial anti-corruption strategies in Iran has been given a rate and this rate is lower than average and relatively weak. However, according to experts, the importance of these strategies to combat corruption in the country is relativelyhigh.
