منازعات قومی یکی از مخاطرات جدی کنونی برای ثبات و امنیت داخلی و صلح و امنیت منطقه ای و بین المللی به شمار می روند. اقلیت، سازه ای جمعی است و گروه، نقشی محوری در شکل گیری هویت جمعی گروه های اقلیت و امکان درگرفتن منازعات قومی دارد. به نظر می رسد که حقوق بین الملل لیبرال، به واسطه پیش گرفتن سیاست بی طرفی و در نتیجه، گشودن راه برای تبعیض غیرمستقیم علیه اقلیت ها از یک سو و پا فشاری افراطی بر فردگرایی و حقوق و خواسته های فردی و نپرداختن به هویت و حقوق جمعی از سوی دیگر، از گروه که نقشی اساسی در بروز و تشدید منازعات قومی دارد غفلت ورزیده و در پیشگیری از تنش ها میان اکثریت و اقلیت یا بین گروه های مختلف اقلیت ناکام مانده است.

The emerging right to democracy (e.g. Franck, T) within international law favors a liberal, democratic packaging. Yet as Abedolkarim Sourash argues, there has been a conflation of liberalism and democracy, which must be decoupled. It is from this point of departure that this paper will examine the international legality of militant democracy and interrogate when and how a constitutional democracy can legally act in an anti-democratic manner to combat threats to its democratic existence. Militant democracy was a term introduced in 1937 by Karl Lowenstein. It refers to a form of constitutional democracy authorized to protect civil and political freedom by pre-emptively restricting its exercise. Lowenstein’s writings, at the time, were concerned with the limitations of democratic institutions in containing fascism. Militant democracies stand in contrast with the principles of legal pluralism, but the extent to which international law authorizes transformative political agendas that seek to implement forms of religious, cultural, or national autonomy is unclear.

With the acceptance of international trade and its expansion in the 20th century, the need to prepare a suitable mechanism to resolve disputes, especially in non-international dimensions, became one of the important concerns to maintain commercial relations and contracts. And this caused that, despite the global skepticism towards arbitration, in a short time arbitration and mediation were considered as a way to resolve conflicts, especially regarding international commercial disputes. On June 26, 2018, the Singapore Convention was approved by the United Nations Commission on International Trade Law (UNCITRAL) regarding international agreements resulting from mediation. And the plan of UNCITRAL was modified in the field of international commercial mediation and international settlement agreements resulting from mediation. The purpose of ratifying this convention is to establish a binding legal system and an efficient framework and legal platform for the implementation of international agreements resulting from mediation. Previously, the adoption of the New York Convention by expanding the use of the arbitration method as a way to settle disputes was considered one of the most successful international treaties in this field. In total, the present research, with an analytical and argumentative method, seeks to respond to the main philosophy of concluding and the scope of application of each of the two New York and Singapore Conventions, by examining the weak and strong points of each, it explains the position of these two treaties in resolving conflicts and disputes and discusses the similarities and differences between the New York Convention and the Singapore Convention on Mediation.

On 15 February 2012, two Indian nationals aboard the St. Antony, an Indian fishing ship, were killed allegedly as a result of gunshot wounds following a confrontation with the Enrica Lexie, an Italian merchant ship, in international waters, off the Indian coast. The nature of the confrontation has been in contention. Enrica Lexie was traveling from Singapore to Egypt accompanied by six Italian navy marines. Enrica Lexie began firing at India's Exclusive Economic Zone because they thought pirate boats attacked them. Indian Navy detained the Enrica Lexie and two Italian navy Marines were arrested on charges of murder of two Indian fishermen. This incident caused the dispute between India and Italy over criminal jurisdiction, functional immunity of Italian navy marines, and the practice of arming merchant ships. They refer this dispute to arbitration and finally, Tribunal issued its award. This paper via the descriptive-analytical method, exploring existing documents, conventions, and customary international law shows that criminal jurisdiction over Italian merchant ships at EEZ belongs to the flag state. Most countries permit and even force to arm their flag merchant ships to fight against pirates, so this practice becomes a rule of customary international law. As a result, actions of these Italian marines are attributed to Italy as a governmental act, and state officials are entitled, in principle, to functional immunity from foreign jurisdiction regarding their ‘official’ acts, i.e., when acting in their official capacity.
آسیب شناسی تاریخی تدوین و تنقیح قوانین و مقررات در نظام حقوقی ایران

با وجود اختلاف های فراوان و اقتضائات خاص هر نظام حقوقی، همه نظام های حقوقی با مسئله شفافیت هنجارهای حقوقی و دسترسی آسان شهروندان به آنها مواجه هستند. اینکه چگونه می توانیم دسترسی به قوانین معتبر را برای شهروندان به آسانی ایجاد کنیم، خود در کشورهای مختلف در صورت های مختلف بروز و ظهور یافته است. ایجاد امنیت حقوقی شهروندان نیز در سایه داشتن نظام قانون گذاری جامع و کارآمد، شناخت دقیق تدوین و تنقیح قوانین و مقررات و نگاه تاریخی به آن با رویکرد مطالعه تطبیقی امکان پذیر است و در نوشتار پیش رو سعی بر این است که گذاری به مفهوم شناسی تدوین و تنقیح قوانین و مقررات و ریشه یابی آن با رویکرد مطالعه تطبیقی و ارتباط آن با امنیت حقوقی شهروندان بپردازیم و غایت این است به روش کتابخانه ای، علل نافرجام نظام بایسته تنقیح قوانین و مقررات در کشور را، در ریشه های تاریخی و مفهوم شناسی آن و نه در آسیب شناسی های مرسوم و رایج آنکه در دیگر مقاله ها و نوشته ها بدان پرداخته شده است، بیابیم. هر چند موارد اخیر را هم مورد اشاره و بررسی قرار خواهیم داد.

The crime of piracy as the oldest international crime has emerged in a modern way in recent years. In addition, piracy is one of the first and main crimes that have been subject to universal jurisdiction. Today, this crime has moved away from its classic way and has progressed to the point of a transformation. This has caused the United Nations Security Council, as the main pillar of maintaining international peace and security, to deal with it many times by issuing resolutions. Despite continuous efforts to prosecute the perpetrators of piracy in domestic courts, the international community has not been able to effectively deal with this phenomenon, because states are facing problems to suppress piracy, including the increasing human rights norms. For this purpose to fight against piracy, new and potential solutions have been proposed, including the establishment of a special international court, referring piracy to the International Criminal Court, as well as dealing with the crime of piracy as a terrorist crime through anti-terrorist conventions. In this regard, according to outcomes of this research, combat to modern piracy in the International Criminal Court can be considered the most effective and efficient way. Compiled with a descriptive and analytical method, by setting this outcome as a hypothesis and examining the characteristics and the limitations of combat to this crime, new and potential solutions of combat to impunity of modern piracy, especially in International Criminal Court, has been discussed.

This article examines the application of Articles 2(4) and 51 of the UN Charter in relation to Israel’s claim of sovereignty over the Golan Heights. Israel has cited historical Jewish rule and invoked “defensive conquest” to justify its position. However, this interpretation misrepresents the non-use of force principle. The article references relevant UN Security Council Resolutions and treaty interpretation rules, emphasizing a strict application of international law, which Israel has overlooked. The UN Charter’s main purpose of maintaining international peace supports this strict interpretation. Consequently, the notion of defensive conquest violates Article 2(4) and customary international law. Additionally, the article discusses the 2024 International Court of Justice Advisory Opinion, which reaffirmed the illegality of Israel’s annexation of the Golan Heights and highlighted the prohibition of acquiring territory by force, as established by the UN Charter.
تأملی بر موارد نقض حقوق بشر در جمهوری فدرال آلمان

سالیانه گزارش های حقوق بشری بسیاری از سوی نهادهای بین المللی، دولت ها، مراکز مختلف غیردولتی و... در مورد وضعیت حقوق بشر کشورهای مختلف ارائه می شود و به مسائل گوناگون همچون تبعیض نژادی، تضییع حقوق اقشار ضعیف جامعه، خشونت علیه زنان و کودکان، حق بر سلامت و بهداشت، منع حمایت از تروریسم و... می پردازد. افزایش بیش از 50 درصدی پخش محتوای مرتبط با پورنوگرافی، افزایش 11 درصدی خشونت علیه کودکان در یک سال، تقویت گروه های افراطی و نژادپرست و... بخشی از وضعیت رو به وخامت حقوق بشری در آلمان است. در این مقاله با استفاده از گزارش های رسمی بین المللی و پایگاه های داده اروپایی و به دور از هر گونه نگاه سیاسی به بررسی موارد نقض حقوق بشر در کشور آلمان که خود از مدعیان حقوق بشر در جهان است پرداخته شده است. روش تحقیق در این مقاله توصیفی تحلیلی است و به هر موضوع حقوق بشری به طور مجزا پرداخته شده است.

مقاله حاضر در این مقام است که از خلال تحلیل پرونده های دیوان اروپایی حقوق بشر و با مطالعه غیرجانب دارانه، کارکردها و آثار مثبت و منفی سقط جنین آزاد - با حداقل محدودیت- فارغ از لحاظ بنیان های اخلاقی، فلسفی یا دینی، دریابد کدام یک از دو دیدگاهِ محدودیت موسّع سقط جنین یا جواز گسترده آن می تواند در عمل برای خانواده یا جامعه به عنوان کل، سودمندتر باشد. این پژوهش در ابتدا با تببین رویکرد دیوان اروپایی حقوق بشر راجع به سقط جنین، دریچه ای به بحث می گشاید و ذیل دو عنوان، به شیوه تحلیلی و کارکردگرایانه، آثار مثبت و منفی سقط جنین در جامعه را برمی شمرد. سقط های مبتنی بر جنسیت، سقط جنین و استثمار زنان و توریسم و صنعت سقط جنین تنها شماری از کارکردهای سوء سقط جنین آزاد در جامعه اند که حتی رفته رفته رویه دیوان اروپایی حقوق بشر را نیز به محدود کردن قوانین سقط جنین منعطف نموده و در تزاحم خواست مادر، حیات جنین، حق پدر بالقوه و سایر عوامل، ترجیح را به برقراری تعادل میان همه منافع درگیر داده است تا خواست مادر.

During its historical life, the Caspian Sea has always been a safe place for many races, people, and governments. Unfortunately, humanity does not appreciate this valuable water zone and steps away consciously or unknowingly on the path to its destruction and demolition. Taking the path in this way is equal to obliterating the roots of the present generation and future generations. With the aim of evaluating the environmental security structure of the Caspian Sea, this research examines a new legal framework for this water zone. Moreover, the research also argued that the Caspian requires effective political and legal decision-making to achieve its ideal state both environmentally and economically or socially. Until the collapse of the Soviet Union in 1991, the Caspian Sea was dominated by the two governments of Iran and the Soviet Union. The intense asymmetry between power and resources between the two countries led to the unofficial and actual control of the region in the hands of the Soviet Union.

Exploiting the bed and subbed of the seas which are outside the governments’ sovereignty is always discussed since the countries severely need to these resources and the technological progress makes it possible to exploit these areas. Present study aims to respond this question that how resources of bed and subbed of the seas outside governments’ sovereignty are exploit based on law perspective, and how can analyze juridical attitude in this issue. In law perspective, according to the 1982 Convention on the Law of the Seas, these areas are the common heritage of humanity and International Seabed Authority is responsible in this field. In Islamic jurisprudence, exploitation of properties which do not belong to a specific person and freely are in access the public is named Anfal. But the bed and subbed of the seas are not included in any of the territories such as Dar al-Harb defined by the jurists, because no government have the right to claim sovereignty over these areas, and Dar al-Kofr is not in charge of these areas either. It is necessary to act based on international treaties and customary in such a situation. It means that Dar al-Islam is committed to act in accordance with existing international treaties and customary. Even if Dar al-Islam has not accepted any treaties regarding the bed and subbed of the seas, it is committed to implement international regulations based on international customary since international customary has known the bed and subbed of the seas outside the governments’ sovereignty as the common heritage of humanity.

Environmental risks and conflicts in the framework of the relations between countries and subsequently their role-playing in interaction and collaboration or conflicts and struggles between political actors especially in the level of states have reproduced serious discussions and disputes on the environment, security, and power which are interpreted as environmental geopolitics or ecopolitics by modern political geography. Geographically, the Persian Gulf is a semi-enclosed sea that has a very low capacity of self-dredging in comparison to that of high seas; hence, it retains the pollutants for longer periods of time. Some of its environmental problems arise from the various activities of the people residing along the northern and southern shores. If the situation is exacerbated by the factors such as oil and its subsequent pollutions, militarism and its subsequent destruction, desalination of seawater, and the construction of artificial islands, one can conclude that regional convergence between the countries neighboring this body of water in the process of bioregionalism would be of an essential necessity. According to the research findings, states acting in the geopolitical region of the Persian Gulf to produce power, security and to sustain them, from one hand, and to protect this shared aquatic ecosystem in the event of sustainable development, from the other hand, should mobilize all collective cooperations and operationalize the bioregionalism in regional and supranational scales.
Legal Implications of an Arbitration Award under the 1982 Convention on the Law of the Sea, Case Study of the South China Sea Arbitration(مقاله علمی وزارت علوم)

The southern part of the China Sea has been the site of one of the most important maritime disputes in five decades. Tensions are so high that some predict World War III will break out in the region. The Philippines's referral for arbitration in respect of some of its disputes with China resulted in the issuing of a 2016 arbitration award. The legal and political significance of this Award has caused debates among scholars. The legality of the Award and the validity of the court's arguments in various positions are among the topics of these discussions. In this study, our main question is how much this award has contributed to resolving and clarifying the legal aspects of the maritime disputes between the parties. Our secondary question is the impact of this Award on regional and international peace. The findings of this study indicate that the arbitral tribunal's approach has a significant impact on understanding the concept of "historical rights" as well as the explanation and interpretation of marine environmental protection provisions in the 1982 Convention on the Law of the Sea. In the tribunal's view, by joining the Convention on the Law of the Sea, the rules concerning maritime zones, except in rare cases, override the historical rights of States. It also played an important role in defining and explaining various maritime features; including islands, rocks, and low-tide elevations. However, the effect of the award on reducing tensions in the southern part of the China Sea, Chinese government policies, and Regional peace is in doubt.
چالش های قانونی و قضائی کرامت انسانی بزه دیده در فرایندهای کیفری

صیانت از حقوق بزه دیده در اندیشه حقوقی اسلام و اسناد مهم بین المللی جایگاه ویژه ای دارد؛ وجود چالش هایی در حوزه قانون گذاری و قضائی، سبب شده است کرامت بزه دیده آسیب پذیر باشد؛ مطالبات بزه دیده به جبران خسارت های مادی او محدود نمی شود بلکه علایق و خواسته های روحی و روانی او قابل توجه است. مقاله حاضر در پی آن است تا بررسی کند چه چالش های قانون و قضائی در راستای تکریم انسانی بزه دیده در فرایندهای کیفری وجود دارد؟ یافته های پژوهش حاضر نشان می دهد علی رغم توجه قانون گذار نسبت به برخی از خواسته های مادی بزه دیده، خلأهای قانونی مهمی به ویژه نسبت به نیازهای غیرمادی او در قوانین جزایی مشاهده می شود؛ با این وجود قانون جدید آیین دادرسی کیفری نشان می دهد قانون گذار در بسیاری موارد به روشنی به حقوق بزه دیده و کرامت او توجه ویژه ای داشته است اما اجرایی شدن این قوانین در مراجع قضائی نظارت ویژه ای را می طلبد مخصوصاً آنکه برخی حقوق بزه دیده در قانون سابق نیز در مواردی اجرا نشده یا متفاوت از هدف حمایتی قانون گذار اجرا شده است؛ با این حال توجه مستمر مراجع قضائی و نظارت مراجع عالی قضائی در این خصوص راهگشاست.
Human Rights, Human Security and Political Theologies

Human rights, particularly in the form of international human rights law, intersect with religion and peace at foundational levels, as symbolically highlighted by the 1948 Universal Declaration of Human Rights (UDHR). The Preamble to the Declaration proclaims in its very first line that respect for human dignity is the foundation of peace, and proceeds to declare that freedom of belief, alongside freedom of speech and freedom from fear, are the highest aspirations of humankind. One could similarly highlight the special relationship between the project of human rights, peace and religion, particularly religious tolerance, in the texts of the universal, as well as regional, human rights instruments adopted since 1948, as well as the text of the Charter of the United Nations of 1945.
The relationship between contemporary human rights, on the one hand, and religion and peace on the other, is arguably determined by the structure of international human rights law as a political discourse, which describes the relationship between individuals, society and the State. The visible influence of social contract theory on the wording of the Universal Declaration reminds us that from its inception, the project of human rights is intimately linked to religious diversity (because of the birth of modern sovereignty in European wars of religion and evangelical imperialism) and peace (because of the connection that the Declaration draws between the stability of States and respect for the human dignity of citizens).
Against this known conceptual and historical backdrop, this paper starts with the displacement, at the global level, of human rights by the ambiguous discourse of "human security," since the early 1990s. A general idea is that "human security", which has rapidly evolved to become an organizing principle of policy-making for governments as well as non-governmental and inter-governmental organizations, constitutes an alternative, sometimes deliberately advocated as such, to the discourse of human rights. Although received, and arguably uninformed, commonsense considers human rights as a threat to State sovereignty, the confrontation of human rights with "human security" reveals, first, how human rights is bound to sovereignty and, second, how "human security" refers to political parameters that are foreign to those of the UDHR. In that sense, this paper discusses how the structurally very deep relationship between peace, religion, and the project of equality in diversity promoted within international law by the UDHR is sidelined by the general project of "global governance," to which "human security" has contributed a legitimate basis for disregarding the sovereignty on which human rights depend.
Methodologically, the paper seeks to bring together a structured and coherent conceptual backdrop to the resistance offered more recently by a group of States to the continuous use of "human security" within the United Nations and beyond. This is done through the use of the technical notion of "political theology," which systematizes the foundational place of religion in political discourse by describing political-theoretical language (such as that of the Universal Declaration) as secularized versions of religious worldviews. This allows for a constructive confrontation of human rights and "human security" as parallel political projects, in a way that describes the project of "human security," connected as it is with other strategic concepts of global governance (like the "responsibility to protect"), as a threat to the original architecture of international human rights law. This threat is shown to derive from "human security's" potential hostility to both human rights' international law component (sovereignty) as well as its human rights component (equality in diversity), particularly by associating humanitarian concerns with the passing security concerns of dominant States.
مدیریت شرایط اضطراری سلامت در دوران بیماری کرونا؛ مطالعه تطبیقی ایران و قطر

در مواقع بروز شرایط بحرانی در کشورهای مختلف، محدودیت هایی برای کنترل بحران وضع می شود تا دولت بتواند در یک طرح سامان دهی شده، اوضاع را تحت کنترل بگیرد؛ علی الخصوص اگر این بحران از جنس شیوع بیماری همه گیر باشد. شیوع ویروس کرونا به مثابه یک بحران جهانی، موجب شد تا همه کشورها با اعلام وضعیت اضطراری و تشکیل کمیته بحران سعی در کنترل این اوضاع داشته باشند. متناسب با اعلام وضعیت اضطراری در قطر نیز کمیته عالی مدیریت بحران شکل گرفت و منطبق بر قوانینی من جمله قانون شماره (2) سال 2012 تحت عنوان «قانون تشکیل کمیته ملی ایمنی زیستی»، قانون شماره (17) سال 1990 تحت عنوان «قانون مقابله با بیماری های مسری»، قانون شماره (13) سال 1997 تحت عنوان «قانون مراحل و مقررات شرایط اضطراری» و قوانین دیگر، آیین نامه هایی برای کنترل کرونا تصویب و ابلاغ شد و بدین ترتیب به جای اینکه مثل ایران به کلی گویی اکتفا شود، دست به ایجاد یک نظام حقوقی خاص برده شد. بنابراین سؤال مقاله این است که «کشور قطر، چه نظام حقوقی اضطراری برای کنترل و مدیریت بیماری کرونا ایجاد کرده است؟». با توجه به تدابیر موفق قطر در کنترل میزان مرگ ومیر ناشی از بیماری کرونا و اینکه نظام تقنینی کشور قطر، از زیرساخت های مناسب تری در مقایسه با ایران بهره مند است این مطالعه تطبیقی از نوع هنجاری و با روش توصیفی تحلیلی انجام شده است.

Today, arbitration has become the most popular means of resolving maritime disputes. Arbitration as a binding dispute resolution method is proposed and recognized in the seventh appendix of the 1982 Convention on the Law of the Sea. One of the important requirements of arbitration is the observance of fair proceedings, which according to the New York Convention of 1958 and the European Convention on Human Rights, is under judicial supervision at the stage of identifying and implementing arbitration decisions and at the stage of protesting the arbitration decision. Considering that arbitration is a type of private judgment, it is required to observe fair proceedings, as a human right, therefore, identifying the fair arbitration and guaranteeing the implementation of its non-compliance is of great importance. Identifying the principle of fair arbitration as a human right and guaranteeing its non-compliance in various cases, in order to violate the human rights of the parties, needs to be read. In the current research, with the analytical and descriptive method and using library sources and judicial procedure and according to the basics of human rights and international documents as well as international judicial procedure, the principle of fair arbitration to It has been recognized as an inalienable human right . And it can be said: the agreement on the cancellation of the right to object to the arbitration award has no effect on the possibility of requesting the annulment of the arbitration award due to non-compliance with the principles of fair arbitration. The request to cancel the arbitrator's decision that is outside the deadline can also be accepted by relying on the principles of fair arbitration, and in case of a request to implement the arbitrator's decision, the arbitrator's decision will not be able to be recognized and implemented.
Analysis of the International Responsibility of Governments In the use of Laser Weapons in Maritime Conflicts from the Perspective of International Humanitarian Law(مقاله علمی وزارت علوم)

In recent years, we witnessed the use of laser weapons in naval conflicts in the Persian Gulf, the Strait of Hormuz and the Sea of Oman. Conflicts that are not armed and under the laws of hostilities and the rights of war are not considered, and the use of laser weapons in them violates the principles of proportionality and necessity in international humanitarian law. Based on the Fourth Protocol of 1995 of the 1980 on Conventional Weapons and Article 86 of International Customary Humanitarian Law, the use of blinding and permanently blinding laser weapons is prohibited. Based on Article 36 of the 1st Additional Protocol of 1977, the governments in the production and use of new weapons should ensure that they are not prohibited from the point of view of international rules.the use of laser weapons in the aforementioned maritime conflicts is a violation of international obligations and has a criminal nature, and according to Article 2 of the 2001 international responsibility plan of governments, it causes the international responsibility of the governments that use it. The main goal of this research is to analyze the international responsibility of governments in using laser weapons in maritime conflicts in the Persian Gulf and the Sea of Oman. Therefore, by using an applied research with a descriptive-analytical method to collect the data obtained through library studies and field investigation, we have sought to realize this goal. The result of the research showed that laser weapons are a violation of international obligations in the field of intimidation, unnecessary pain and suffering, use by terrorist groups, intelligent murder,violation of the right to life and the right to reproduction. humanitarian rights, human rights and mandatory rules and universal obligations are international and are considered an international violation and cause the international responsibility of governments.

An individual who breaks a law that conscience tells him is unjust, and who willingly accepts the penalty of imprisonment in order to arouse the conscience of the community over its injustice, is in reality expressing the highest respect for the law. Martin Luther King, Jr. Abstract The following paper will present the theory and possibilities of implication of the phenomenon of civil disobedience understood as one of the most powerful and most effective tools of democratic society when it comes to implementing the necessary and indispensable changes required for the improvement of the political domain and the social public sphere. In the first part I will present the narrow but orthodox and widely discussed definition of civil disobedience presented by John Rawls in his Theory of Justice (1971). Given such a definition, as well as the major conditions under which the actions undertaken in the name of civil disobedience can be justified, I will focus my analysis on two major aspects of the discussed notion. Firstly, I will discuss civil disobedience, which is in its essense an unlawful act, paradoxically expresses the highest respect for the positive law by the person performing the civilly disobedient act through one’s submission to the judgment of the law which is an object of one’s protest. This way, civil disobedience presents itself as the phenomenon which, not having a legal recognition (not being legalized), holds super-legal force required to impose the changes on the unjust legal system or on the particular unjust regulation. Secondly, I will point out that civil disobedience, as a public act performed by the people (the subjects of the particular law), expresses the will of the people and, therefore, it can not be used (by themselves) in the ways contradictory to their best self-interest but always supported by the “the commonly shared sense of justice” (Rawls). From this premise I conclude that the universal human rights, as thier supporters claim, are one of the main ends of the political activism in the recent decade and should be advocated in the civilly disobedient manner. In the last part I will contrast the Rawlsean definition with a much broader and more relevant understanding of civil disobedience when it concerns today’s globalizing world. In this world, the nation-states cease to be the only political actors when confronted with the transnational public sphere, and, therefore, the understanding of civil disobedience as a transversal arena of public dissent presented by Roland Bleiker (2000) is more appropriate. In this definition civil disobedience becomes, not only a political instrument of particular subjects of a particular society, but it also becomes a tool for the international mobilization of means and of people in the name of presenting and imposing the respect for the universal human rights despite the national borders and societal paradigms.

حاکمیت یکی از بنیادین ترین مفاهیم حقوق عمومی و علوم سیاسی است که هر تغییری در این مفهوم کل حقوق عمومی و علوم سیاسی و روابط قدرت با مردم را تحت تأثیر قرار می دهد. شهروندی-و به تبع حقوق شهروندی- نیز بیان یک وضعیتی است که در آن به دلیل ارتباط فرد با حاکمیت، حقوق و تکالیفی برای فرد ایجاد می شود. فلذا تحقق حاکمیت -در یک وحدت مفهومی- لازمه ی تحقق حقوق شهروندی است. برای بحث از امکان حقوق شهروندی، پرسیده شد که «آیا حاکمیت در معنای مدرن آن-که به مثابه ی یک پدیدارحقوقی و تاریخی است- در ایران معاصر تحقق یافته است؟». آنچه محصول این تحقیق بود این است که مفهوم حاکمیت در ایران مدرن همواره مفهومی چند پاره بوده و هرگز نتوانسته به یک وحدت در توضیح خود برسد. این چندپارگی محصول تلاش نیروهای متضاد در اعصار مختلف و تأثیرگذاری آنها در شکل گیری این مفهوم در نظام حقوقی ایران بوده و هست . تحقیق حاضر با بررسی دکترین های حقوقی و اقوال جریان های متضاد با روش استنباطی و تفسیری و استدلالی به صورت اسنادی و رجوع به متن حقوقدانان و تقریر نظریاتشان، سعی در صورتبندی نظری پدیدار حاکمیت داشت برای نشان دادن این چند پارگی.
