چکیده
ورزش یکی از مؤلفه های مؤثر تربیتی و اخلاقی در جهان می باشد؛ و در دنیای معاصر نیز به دلایل مختلف علمی وپزشکی از پدیده های الویت دار بوده و جهان شاهد توسعه آن است، به طوری که هزاران نفر از سراسر دنیا مخاطب فعالیت های ورزشی، خصوصا مسابقات المپیک هستند و در این میان بروز حوادث و آسیب ها در جریان رویدادهای ورزشی امری طبیعی است، آن گونه که در المپیک 2020 در رشته های مختلف اتفاق افتاد بر همین اساس، وضع قوانین و مقررات مخصوص به آن نیز گریزناپذیر است ؛ برآیند این پژوهش آن است که قانونگذار، حوادث ورزشی را به شرط التزام ورزشکار به مقررات و قوانین ورزشی در زمره جرائم به شمار نیاورده و به واسطه برائت صادم با عنصر رضایت مصدوم، حاکمیت عرف و به دلیل عملکرد ورزش در بلندقدر شدن و تعالی اخلاق، برای آن مجازات جزایی در نظر نگرفته است اما در صورت مواجه با کمترین نقض مقررات ورزشی و مغایر شدن با موازین شرعی قائل به مسئولیت کیفری ورزشکار صادم شده است.A new look at the criminal responsibility of sincere athletes based on ethics, jurisprudence and law in the context of the 2020 Olympics

Injuries are common during sporting events, as was the case at the 2020 Olympics in various disciplines, so it is inevitable to have specific rules and regulations; The result of this study is that the legislator did not consider sports accidents as crimes under the condition of the athlete's adherence to sports rules and regulations, and due to Sadam's innocence with the element of injured satisfaction, customary rule and due to the performance of sports in uplifting and moral excellence, There is no criminal punishment for it, but in case of facing the slightest violation of sports regulations and contradicting the sharia standards, the athlete is given criminal responsibility.
