در دوران معاصر شاهد انسانی شدن حقوق بین الملل در پی بین المللی شدن حقوق انسانی و نیز انسانی شدن امنیت و پذیرش امنیت انسانی در جامعه بین المللی هستیم. بیماری های جهان گیری مانند کرونا به مثابه یک دغدغه مشترک یا نگرانی جمعی بشری قابل ارزیابی هستند که ضمن آنکه امنیت انسانی را به مخاطره می افکنند، در صورت عدم مدیریت صحیح و کارآمد می توانند به تهدیدی علیه امنیت ملی کشورها و حتی تهدیدی علیه صلح و امنیت بین المللی مبدل شوند. در این مقاله با روشی توصیفی تحلیلی، قلمرو مفهومی حق بر سلامت به عنوان مهمترین حق در معرض خطر این ویروس مورد واکاوی قرارگرفته و عملکرد سازمان بهداشت جهانی در این رابطه مورد ارزیابی قرار می گیرد. این مقاله بدین نتیجه رهنمون می شود که حق بر سلامت به عنوان حقی اجتماعی که متعلق به نسل دوم حقوق بشر است و بنا به خصلت ذاتی خود نیازمند مداخله ایجابی دولت هاست اما در زمان بروز بیماری های جهان گیری مانند کرونا، اقدام انفرادی دولت ها کارآمدنبوده و حصول نتیجه در گرو همکاری، هماهنگی و همبستگی بین المللی است.
بررسی نقض دادرسی منصفانه در نظام شاهنشاهی پهلوی

اصول دادرسی منصفانه شامل عناوینی نظیر اصل برائت، حفظ حریم خصوصی، بهره مندی از حقوق دفاعی، مستند بودن به قانون، منع وعدم شکنجه، حق تجدیدنظرخواهی، رسیدگی علنی و... است، کامل ترین راهکار برای عدالت قضائی به عنوان اصلی ترین فرع عدالت اجتماعی، رعایت اصول دادرسی منصفانه است. در این پژوهش نگارندگان با بررسی مفاهیم مبنایی مرتبط با اصول دادرسی منصفانه تلاش کرده اند، به تعریفی جامعی از این مفهوم اشاره نمایند و سیر تدوین و تحول قوانین مختلف خصوصاً قوانین جزایی را مورد توجه قرار دهند. نگارندگان با روش توصیفی تحلیلی در پی پاسخ به این سؤال هستند که تا چه میزان اصول دادرسی منصفانه در رژیم پهلوی نقض یا رعایت گردیده است؟ نتایج این مقاله نشان می دهد عمده قوانین از موازین دادرسی منصفانه تبعیت نموده اند، البته با وجود دادگاه های نظامی و محاکم تشریفاتی و عدم رعایت اصول آیین دادرسی نسبت به زندانیان سیاسی، در رژیم پهلوی دادرسی منصفانه به شدت تضییع شده است. علت پرداختن به این موضوع در این بازه زمانی، شرایط، منحصر به فرد ایران در زمان حاکمیت رژیم پهلوی خصوصاً تحولات سیاسی اجتماعی آن روزگار و نیز نقش ویژه نظام قضائی در زندگی مردم بوده است. در پژوهش های متعدد درباره اصول دادرسی منفصانه و ابعاد آن تحقیق به عمل آمده است اما از لحاظ بررسی رعایت این اصول در رژیم پهلوی کمتر مورد توجه قرار گرفته است.

عوامل گوناگونی می توانند ارزیابی خسارت ناشی از نقض استانداردهای حمایتی معاهدات سرمایه گذاری را در داوری های سرمایه گذاری تحت تأثیر قرار دهند که دسته ای از آن ها مربوط به دولت میزبان است. این مقاله به مطالعه بحران اقتصادی دولت و همه گیری جهانی، وضعیت اقتصادی سیاسی دولت میزبان سرمایه گذار و تعهدات خارج از معاهده سرمایه گذاری دولت و نیز تأثیر این عوامل در محاسبه خسارت در دعاوی سرمایه گذاری می پردازد.بحران اقتصادی دولت در صورتی که منجر به اقداماتی از سوی دولت برای مقابله با بحران شود که اصولاً ناقض تعهدات دولت در معاهدات سرمایه گذاری باشد، می تواند در قالب ضرورت به عنوان رافع وصف متخلفانه عمل دولت مطرح شود. در بسیاری از معاهدات سرمایه گذاری، شروطی در خصوص اقدامات منع نشده دولت وجود دارد که موجب شکل گرفتن بحث ارتباط این مقرره با مقررات حقوق بین الملل عرفی در خصوص عوامل رافع وصف متخلفانه عمل دولت می شود. دیوان های داوری به راه حل روشنی در خصوص نحوه تعامل این دو دسته از مقررات نرسیده اند. مسئله تأثیر وضعیت کلی اقتصادی دولت میزبان و همچنین تعهدات خارج از معاهده سرمایه گذاری دولت نیز به عنوان مبانی تعدیل خسارات مطرح شده است. به نظر می رسد در چشم انداز آینده موضوع مقاله، تحولاتی با توجه به دعاوی احتمالی آینده در راه باشد.

The South China Sea, along with the Korean Peninsula and the Taiwan Strait, is described as one of the three hotspots in East Asia because of its potential for conflict of interest and threat to peace and security. Therefore, the issue of its borders is of international importance. As a quasi-closed sea, it is home to numerous small islands and cliffs, as well as abundant living and non-marine reserves, as well as providing key maritime routes for commercial navigation. For these reasons, the sea has become the target of conflict between coastal countries and its neighbors. In this sea, the main issues in dispute are: 1- Border disputes over the determination of the lines of origin, the boundaries of the territorial seas and also the exclusive economic zone2. Territorial disputes over several islands, including the Paracel and Spratly archipelagos. Because of its superior power, as well as some unproven historical claims, China sets the nine-dash as the final line of its sovereignty, some of which extend as far as the coastal sea. The United States and the countries bordering the South China Sea strongly oppose this, as well as China's historic claims. The littoral states of the South China Sea consider the historic claims and the nine-dash claimed by the Chinese government to be contrary to the laws of the UN Convention. The United States, as a trans-regional player, also provides diverse support to coastal countries. In this research, with a descriptive analytical approach and using new sources, the disputed issues between the claiming countries have been studied and the role of the United States in terms of geopolitical competition has been analyzed.

امروزه تروریسم، اشکال متنوعی به خود گرفته و یکی از انواع آن که صلح و امنیت را در دریاها به خطر می اندازد، «تروریسم دریایی» (Maritime Terrorism) است. با وجود آنکه پذیرش کنوانسیون 1982 حقوق دریاها موجب تقویت حفظ صلح و امنیت بین المللی در دریاها شده است، این کنوانسیون به طور خاص قواعدی در زمینه منع و سرکوب تروریسم دریایی ندارد. وقوع حادثه آشیل لائورو در 1985 نشانگر خلأهای حقوقی موجود برای مواجهه با تهدیدات امنیتی ناشی از فعالیت های تروریستی در دریاها بود. برای رفع این خلأها، سازمان بین المللی دریایی، کنوانسیون 1988 سرکوب اعمال غیرقانونی علیه ایمنی دریانوردی و پروتکل 2005 آن را تصویب کرد. هدف این مقاله، بررسی و تحلیل محتوای این اسناد و قابلیت آن ها در چارچوب مبارزه مؤثر با تروریسم دریایی است. مقاله نتیجه می گیرد که برای مبارزه مؤثر با تروریسم دریایی ضرورت دارد که این کنوانسیون ها برای اهدافی همچون اتخاذ اقدامات پیشگیرانه، تعقیب و مجازات مرتکبین، و رفع تعارضات احتمالی با قواعد حقوق بین الملل دریاها تقویت شوند.

The naval conflict has undergone many changes due to environmental factors and various tools, as well as the increasing growth and development of marine technologies, aligned with the inclusion of new tools and methods in naval conflict and electronic warfare at sea. The procedure taken by countries indicates the acceptance of electronic warfare as one of the methods and tools of agreed warfare. However, from the perspective of international humanitarian law, the use of electronic warfare tools and methods is challenging, and international treaty law lacks a legal rule regarding this method of warfare. Indeed, the only guideline that has sought to regulate electronic warfare is the Air and Missile Warfare Directive, which imposes no legal requirements on governments. So the question we are going to answer in this brief is that, can humanitarian law be applied to electronic warfare? The purpose of this study is to explain and investigate the various dimensions of naval electronic warfare from the perspective of international humanitarian law, and proving that international humanitarian law can be applied to the methods and tools of electronic warfare at sea. The research method selected for the present paper is an analytical-explanatory method and the data collection method used is the library research method.

There is an urgent need for methods by which people and communities of faith peacebuilding and human rights development. This paper argues for a holistic understanding of peacebuilding that includes security of life, a guarantee of subsistence, and the pursuit of other fundamental human rights. This need is especially acute in countries of rising instability or post-conflict rebuilding. More and more countries face a downward spiral of instability even though many leaders and bodies seek to reverse this trend. Sadly, even among those countries that emerge from conflict, one-half revert to conflict within five years. Hence the question this paper addresses is, “How shall people and communities of religious conviction be effectively engaged in a peacebuilding and human rights process?” <br />This people factor is too little understood, even though the role of citizens in transitional states has long been acknowledged as essential for just and sustainable change. For peace accords and international conventions, in and of themselves, do not make peace or deliver human rights. Neither does the arrival of international peacekeepers nor the speeches of clerics and political leaders. While these developments are helpful stimuli, real human peace and security derives from community-based initiatives that create a “positive deviance” for peaceable, rights-oriented living vis-à-vis governments and other forces. <br />Thus this paper will hypothesize a methodology whereby citizens engage religious institutions, governments (local and national), and international change agents to transform conflict into promising peace and rights. It will identify common peacebuilding principles operating across sectors of human development, security, and rights-oriented work. These sectors may include at least the following: health, conservation, education, security, labor, spirituality, and corporate social responsibility. <br />This paper also seeks to hone a typology of human rights and peacebuilding challenges facing countries of instability and post-conflict rebuilding. Categories may include at least the following: stages and types of conflict, fragile and failed states, overlooked populations, ethnic and racial discrimination, transnational politics and justice, natural resource and wealth distribution, and social capital.

After the atrocity’s committed during the Second World War, the citizens of the world cried out for a universal code of ethics. On December 10th 1948 the General Assembly of the United Nations adopted a universal declaration of human rights, thus setting a new standard for all nations to follow. According to Article 18 of that declaration “Everyone has the right to freedom of thought, conscience and religion; this right includes freedom to change his religion or belief, and freedom, either alone or in community with others and in public or private, to manifest his religion or belief in teaching, practice, worship, and observance”. People, and women in particular, who are born in different parts of the world have different cultural, as well as religious identities. It is time for education on, and a universal understanding of, the identity differences of Muslim women to be made universally accessible, and understood. Although the ultimate result was the near obliteration of an entire race, and a worldwide war, the groundwork was laid in a much quieter manner. The Nazi party slowly began working their ideals into society. First espousing the sovereignty of the German race and then planting the seeds for the loathing and contempt that would follow for all other races. Near the end of the Second World War Adolph Hitler described Jewish people as “something aggressive” the same words that French president Jacques Chirac recently used when petitioning Parliament to pass a law banning the wearing of hijab in France?

حملات مسلحانه مستمر و بدون تفکیک نیرو های مسلح رژیم صهیونیستی به منطقه مسکونی غزه از 7 اکتبر تا کنون، با توجه به عضویت رژیم صهیونیستی درکنوانسیون های چهارگانه ژنو ۱۹۴۹، نقض فاحش قواعد بین المللی حقوق بشردوستانه می باشد. علاوه بر این، با توجه به عرفی قلمدادشدن قواعد و مقررات حقوق بین الملل بشردوستانه، رژیم صهیونیستی نمی تواند با استناد به عدم عضویت خود در پروتکل های الحاقی اول و دوم 1977 و اعلام قصد ترک کردن موقعیت خود به عنوان قدرت اشغالگر از سال ۲۰۰۵، از مسئولیت بین المللی خود به عنوان قدرت اشغالگر شانه خالی کند. رژیم صهیونیستی در اقدامات مسلحانه اخیر خود به غزه، عملاً مرتکب مجموعه متنوعی از نقض های قواعد بنیادین حقوق بشردوستانه بین المللی در سطحی گسترده شده است، ازجمله تخریب بیمارستانها، مراکز آموزشی و فرهنگی، زیرساخت های شهری، حملات کورکورانه به منطقه مسکونی غزه و قتل عام حدود 21 هزار نفر از 2 میلیون و 300 هزار نفر مردم غزه شده و بدین ترتیب با آواره کردن مردم و اعلام قصد کوچاندن جمعیت غزه مرتکب جنایت نسل کشی، جنایات جنگی و جنایت علیه بشریت در سطحی گسترده، گردیده است. بر همین اساس می توان مسئولیت کیفری آمرین، عاملین و هدایت کنندگان جنگ اخیر غزه را به دلیل نقض آشکار اصول و قواعد اساسی حقوق بشردوستانه احراز کرد و آنها را طبق ماده 8 اساسنامه دیوان کیفری بین المللی به عنوان جنایتکار جنگی جهت تعقیب و محاکمه مورد توجه قرارداد؛ خصوصاً آنکه عضویت فلسطین در دیوان کیفری بین المللی، مبنای صلاحیت این دیوان برای رسیدگی به جنایات مذکور را ایجاد کرده است. بنابراین نوشتار حاضر در پی بررسی نقض های رخ داده در غزه، واکنش نهادهای بینالمللی و در نهایت، تحلیل وقایع رخ داده است.

در دوران پیش از برجام، دعاوی متعددی در ارتباط با اشخاص ایرانی در برخی دادگاه های داخلی به دلیل تحریم های شورای امنیت سازمان ملل متحد علیه ایران اقامه شد. ازجمله این آرا می توان به آرای دادگاه های سنگاپور، بریتانیا و هلند اشاره کرد. دعاوی مطرح در دادگاه های مذکور، فرصتی فراهم کرد تا دادگاه ها موارد ادعایی در پرونده ها را با لحاظ محدودیت ها و موانع ایجادشده در قطعنامه های شورای امنیت سازمان ملل متحد و مقررات داخلی ذی ربط بررسی و ارزیابی کنند. آرای این دادگاه ها نشان می دهد که چگونه می توان از نظام های قضایی داخلی به نفع طرف های ایرانی استفاده کرد. این گونه دعاوی که آمار دقیقی از آن ها در دست نیست، آن چنان که شایسته است، مورد توجه جامعه حقوقی ایران قرار نگرفته است. رویه قضایی حاصل از این دعاوی می تواند به اشخاص ایرانی فعال در بخش تجاری و همچنین نهادهای دولتی دست اندرکار کمک کند تا در دوران پسابرجام، رهیافت حقوقی کشورهای مختلف را در بررسی اختلافات حقوقی مرتبط با تحریم های اعمال شده بر ایران درک کنند و آن ها را در آینده روابط حقوقی خود با نهادهای دولتی و خصوصی کشورهای دیگر مدنظر قرار دهند.

The formation and activity of naval alliances formed in the waters of southern Iran may lead to a critical situation in the region and an increase in military tension between the naval units of the Iranian army and the military units of the coalition forces. In response to this question, the current research, what roles can the Navy of the Islamic Republic of Iran play in confronting naval coalitions? This research is applied in terms of purpose and qualitative in nature. For this purpose, qualitative data was collected by using a questionnaire and through semi-structured interviews with 12 experts and specialists of the Navy, and then by using the method of foundational data theory, the data were coded through three stages of open coding. Axial and selective coding was analyzed and the result was 8 general categories, which in the form of a paradigm model include causal conditions (building power at sea and confidence building at sea), axial category (maritime geopolitical position of Iran), conditions Background (naval knowledge and naval ability), intervening conditions (diplomacy capacities), strategy (development of oceanic navy) and consequence (strengthening of Iran's naval power) were introduced.

According to Article 7 of the Rome Statute, the crime of Apartheid refers to actions, policies, and courses of conduct with the purpose of maintaining an institutionalized regime of systematic racism and racial domination. Based on this definition, the word "Apartheid" will not only refer to the historical regime of South Africa (1948-1994) but is also recognized as a crime against humanity on par with torture and slavery. Due to certain similarities in legal systems and roots of establishment, Israel and the Apartheid Regime of South Africa have been considered to be analogous in various international documents sponsored by the United Nations until 1991. This study aims to analyze the historical rationale behind this recognition and the reversal of course by the United Nations General Assembly, which was initiated with the revocation of A/RES/3379 resolution (the equation of Zionism with racism). Furthermore, in the light of recent developments on domestic and international levels, it seems several unaligned trends are gaining ground in this respect to reaffirm the previous attribution of the crime of Apartheid to Israel. Through using E-Library data and employing the descriptive-analytical method, the veracity of the said trends, their projection, and their perseverance will be further discussed in this paper.

Universality of common human values embedded in declarations and international treaties supposed to be evident in the international human rights legal system but it does not mean that there were no intellectual discrepancies behind those instruments. Universality of human rights has its roots more than anything on theories of Jhon locke's natural law and Immanuel kant's rational ethics . But one of the earliest philosophers of opposition side against unity of human nature and universal morality at the embryonic stage was Nietzsche . Bringing forth the theory of will to power by adopting a psychological genealogy method Nietzsche distinguished between two moralities: Masters Morality and Slaves Morality . He attributed human rights as slave morality. Slaves revolted with the spirit of resentment and womanish deception against masters then introduced their own qualities as standard and universal . The Rise of Christianity and the Great French Revolution are amongst two biggest examples of such slave revolt in morality. With such a presupposition, trying by any effort to reconcile human rights morals with Nietzschean views seems to be unachievable. While reviewing past philosophical challenges, this article tries to analyze necessity of co-existence both international human rights legal system and Nietzschean world from a new perspective.
The Involvement of the United Nations System in Promulgation of International Arbitrations among Its Member States(مقاله علمی وزارت علوم)

Arbitration, as a method of pacific settlement of disputes, is mentioned in Article 33 of the Charter of the United Nations, by which parties to any dispute endeavor to find a solution to eliminate their conflict. Yet, article 33 does not include other forms of arbitrations that the United Nations System deals with. International arbitrations are generally referred to as interstate arbitration, international commercial arbitration, and international investment arbitration. Although these arbitration-based methods of international dispute settlement are different, they all observe the same goal: the settlement of disputes by peaceful means and preventing the parties from resorting to adverse behavior. Due to their common goal, it calls the role of the United Nations in promulgating international arbitrations among its member States into question: Has the UN had any bold involvement in promoting and strengthening international arbitrations in the abovementioned fields? It seems that the influence of the UN on interstate arbitration is undeniable because of its main goal and principles; however, this article depicts that the UN policy regarding international arbitrations adheres to the forming and developing international commercial arbitration and international investment arbitration rather than inter-state arbitration. The UN also plays a mediocre role in developing thematic-oriented international arbitrations.

The conflict between sovereignty over parts of the sea and the necessity of "innocent passage" concept has been the most contentious field in the law of the sea." Two hypotheses in this field have collided in the history of international law of the sea. The first hypothesis is that every human possesses the seas together. "Navigation" and other operations are also allowed for all. Under the excuse of owning the sea, no state has the right to restrict other people's use. However, the second theory says that the sea is owned by someone who controls part of it, and its use can be limited. In international law, the "innocent passage" by foreign vessels from the territorial sea of a country is widely recognized. However, in some territories, the requirements for the "innocent passage" of military vessels include the need for prior notice or the coastal state's permission. Most forces, led by the US, believe in absolute freedom of the military vessel's "innocent passage." However, most Asian countries, including Iran, assume that they can prior notification or approval for a foreign military vessel passage. This activity was often resisted in operational as well as diplomatic phases by naval forces such as the United States.

In the third millennium, the number of environmental variables and the nature of the complex relationships between them have resulted in the complexity of competition in the business. Accordingly, the role of organizational intangible capital has been more touchable than ever. Actually, as the intensity of competition increases, the importance of intangible capital enhances and the importance of physical and fixed capital decreases. Due to its geopolitical situation and the presence of extensive maritime boundaries in the north and south, Iran possesses countless strengths and opportunities to obtain maximum resources and benefits from this God-given blessing. Therefore, preservation and expansion of maritime institutions in Iran has been raised as an undeniable necessity in all short- and long-term government plans. This study aims to have policy making regarding the management of organizational intangible capital and its impact on knowledge productivity in maritime institutions of the country. Participants were the experts of Iran’s maritime organizations, which include IRI strategic Navy, the Ports and Maritime Organization, and the National Iranian Tanker Company. Standard questionnaires were employed for data collection. Results showed that focusing on intangible organizational capital in the policy making of maritime institutions can have a significant impact on knowledge productivity in them, which can lead to benefiting from national capacities in maritime studies.

Minerals in nature are one of the most valuable treasures on the earth, which due to the limitation of these resources on land and its heterogeneous distribution in different countries, has made human beings think about extracting the new resources. The limited mineral resources on land and the heterogeneous distribution of these substances in different countries have made human beings think about extracting and using the resources of other parts of the earth and even other planets. Deep-sea mineral resources can be considered as a reliable alternative to compensate for the limitations of land resources. The developed countries were more concerned with the use of these resources than others because, given the dependence of their economies on third-world mineral resources, the development of offshore resources could mean the liberation of their economies from this dependence. In political and scientific circles, the concept of the common heritage of humanity was gradually introduced, based on which activities related to mining in the deep sea. The method of this research is a descriptive-analytical study using library resources, the study of articles, and a review of environmental treaties and related internet resources. The result of this research shows, that none of these legal systems in the field of responsibility can respond to the challenges independently. This research tries to provide a legal solution by considering the opinions of environmental experts, an executive solution about achieving new financial resources based on combined systems of environmental responsibility.
Investigating the Use of IRI Navy Logistics Capacities in Case of Encountering a Crisis Institutions(مقاله علمی وزارت علوم)

Throughout history, Iran has always been exposed to many natural and unnatural crises due to its geographical, economic, cultural, natural, and political characteristics, and especially its location in the strategic region of the Middle East. This study aims to investigate the position and role of the logistics capacities of the Islamic Republic of Iran Navy (IRI Navy henceforth) in encountering the natural disaster crisis. The entire participants included 120 senior officers of the Deputy of Readiness and Support, the heads of readiness and support of the affiliated regions and bases, and the middle managers of the headquarters and ranks of the Readiness and Support Command of Najaf among whom 92 were selected randomly based on Krejcie and Morgan’s (19700 table. Data were collected quantitatively using researcher-made disaster management questionnaires and IRI Navy preparedness capacities. Then, the validity of the questionnaire was assessed through confirmatory factor analysis and its reliability was assessed by Cronbach’s alpha. To test the hypotheses and the accuracy of the conceptual model of the research, the structural equation modeling method using the partial least squares (PLS) method was used. Findings indicated the significance of the IRI Navy's preparedness hypotheses on managing and reducing the damage caused by the natural disaster crisis. The results showed that the component of responsibility had the highest rank and importance and the components of timeliness, information, and technology, coordination, mobile systems, efficiency, and preparedness were among the next priorities of logistics capacity in case of encountering a natural disaster crisis, respectively.
A Critical Analysis of Application of Proportionality Test and Margin of Appreciation Doctrine by European Court of Human Rights(مقاله علمی وزارت علوم)

European court of human rights was established in 1959 as an independent court of Council of Europe in order to deal with alleged violations of human rights which has been enumerated in European Convention on human rights. Obviously, protection and evolution of human rights obligations is considered as one of the most significant concerns of this court. In addition, the protection of human rights and public interest together Are required for an efficient society. As a result, European court of human rights must use a mechanism by which it can have a reasonable and balanced operation to realize these two fundamental values. In order to approach this aim, the court uses the proportionality test, consisting of three principles of legitimacy, appropriateness and necessity. Despite its efficient results for the Court, the application of this test has its deficiency in keeping a balance between human rights and public interest. This court authorized the member states to evaluate the legitimacy of an aim by themselves, however it should be the court’s task to pass three steps of proportionality test independently. This research mainly concentrates on the evaluation of the European court of human rights from the doctrine of margin of appreciation perspective.
دموکراسی و حقوق بشر به عنوان چالش هایی در برابر هویت ملی «تُرکی»(مقاله علمی وزارت علوم)

محور بحث این مقاله، معضل هویت و میزان موفقیت جمهوری ترکیه در گرد آوری مردم به دور هویت « ترک» است که از سوی دولت تحمیل گردیده است. این مضمون با اشاره به دو چالش مهم در برابر نقش ممتازی تشریح می گردد که از زمان تأسیس جمهوری در سال 1923 به [هویت] « ترک» اعطاء گردید: ]یعنی[ افزایش بی سابقه هویت اسلامی و ظهور هویت «کُرد». این مقاله استدلال می نماید که موارد نقض حقوق بشر در ترکیه را نباید فقط ناشی از قوانین بد، حکومتهای بی رحم و دیوانسالاری بد دانست، بلکه این موارد، برون رویز بیماری های عمیق تری است که بازتاب سیاست هویت موجود در آن می باشد. اینگونه استدلال می شود که هر چه هویتهای جمعی و فردی از هویت سیاسی شده همگن ساز که «ملت» و «دولت» را می ستاید « رها شده تر» باشد، تنش ها و موارد نقض حقوق بشر از طریق روش های انطباق بیشترکاهش خواهد یافت.
