واکاوی انتظام اقتصادی در پیشینه تاریخی و تحلیل کارکردی پلیس: مبنایابی پلیس اقتصادی

چکیده
خاستگاه و تحول سازمانی که در حال حاضر «پلیس» نام دارد، در طول تاریخ کشورها و ایران نشان از مسئولیت سنگین این نیروی چندوجهی و چندکاره اگر نگوییم همه کاره دارد. پلیس از ابتدا در عرصه مدیریت شهر و روستا و حفاظتِ بندری ظهور یافته و در طول تاریخ، جنبه های مختلف مذهبی، سیاسی، نظامی و شبه نظامی به خود گرفته است. امور تحت پوشش مسئولیت پلیس بسیار متنوع بوده و گاه گستره ای محدودناشدنی داشته است. در جوامع اسلامی افرادی با عناوینی مثل محتسب و شرطه عهده دار مسئولیت هایی بوده اند که با مسئولیت های پلیس در تاریخ سایر کشورها تا حدی قرابت داشته است. در ایران پیش از اسلام نیز پلیس نیرویی منظم و تأثیرگذار بوده و در طول تاریخ نام های مختلف یافته است. شکل گیری اولین نیروهای انتظامی، از جمله با تشکیل «ژاندارمری خزانه» (پلیس اخذ مالیات و عوارض زیر نظر خزانه دار) در کنار «ژاندارمری دولتی» همراه بوده است. در یک دسته بندی بسیار کلی، وظایف نیروی انتظامی در ایجاد و حفظ و ارتقای نظم و امنیت و آسایش خلاصه می شود که تحقق آنها مستلزم فراهم آوردن زمینه های ذهنی و عینی و مقابله و برخورد با فعالیت های غیرمجاز ضمن ملاحظه امور مرتبط است. از سوی دیگر، این نیرو ضابط عام دادگستری است که درباره کلیه جرایم صلاحیت اقدام دارد و وظایف و اختیاراتش محدود به جرایمی معین یا شرایطی خاص نیست و یکی از وارثان نظام حسبه اسلامی به شمار می رود. به تأکید، این مقاله درصدد همه کاره جلوه دادن یا افزایش خارج از معمول وظایف و مأموریت های نیروی انتظامی در حال حاضرِ جمهوری اسلامی ایران نیست. با وجود این، عرصه اقتصاد و انتظام برنامه ریزی شده و هوشمندانه آن در دوران فشارهای فزاینده خارجی، ناکارامدی های اجرایی و فسادانگیزی های فراتر از انتظار داخلی و تأکید مقام معظم رهبری بر تحقق ناگزیر اقتصاد مقاومتی، عرصه ای است که به هر صورت باید در آن جایگاهی شایسته برای نیروی انتظامی جمهوری اسلامی ایران تعبیه کرد که پیشینه تاریخی چنین جایگاهی از آن بیگانه نیست و کارکردهای قانونی اش به خوبی ظرفیت آن را دارد.An Examination of Economic Management in the Historical Background and a Practical Analysis of Police: Foundations of Economic Police
The origin and evolution of the organization called ‘police’, during Iran’s history, direct attentions to the serious responsibility of this multi-dimensional multi-functional force. Police was initially founded to manage urban and rural areas and to guard ports. Throughout the history, it took on various religious, political, military, and paramilitary aspects. Nowadays police bears a wide variety of responsibilities, the extent of which is indefinite. In Islamic societies, there had been figures assigned as ‘Mohtassib’ and ‘Shorteh’. Their responsibilities were similar to the responsibilities of police in other countries. In pre-Islamic Iran, police was a disciplined influential force adopting different names throughout history. The formation of the first modern police, the establishment of ‘Jandarmeri-e Khazaneh’ (collecting tax and duty under the supervision of treasurer) coincided with the formation of the Government Gendarmerie. Police’s responsibilities, in a general classification, can be summarized as the formation, protection, and promotion of order, security, and welfare. All of these are materialized in the event that objective contexts are prepared and illegal activities are countered, after due consideration. Furthermore, police is the general bailiff of the judiciary system. It is authorized to act against all crimes. Its duties and authority are not limited to certain crimes. It is, in fact, an heir to the Islamic system of ‘Hasbeh.’ This paper does not intend to show that police’s responsibilities in the Islamic Republic of Iran are beyond the norms. However, new responsibilities must be defined for police regarding the country’s economy, its planned smart management during the increasing foreign pressures, executive inefficiency and corruption in domestic areas, and the Leader’s emphasis on the implementation of Resistance Economy. The history of police in Iran and its legal functions show its high capacity.
