نظم و امنیت در فقه شیعه به مثابه قاعده فقهی و حقوقی

چکیده
نظم و جریان امور طبق همگرایی انسان ها در جوامع مختلف به منظور انتظام بخشیدن به ارکان و نهادهای جامعه و تحصیل امنیت در ابعاد گوناگون، جزو ضروریات و مسلمات زندگی اجتماعی است. تلاش برای استقرار چنین نظم و انتظامی از یک سو و پرهیز از هرگونه هرج و مرج و اختلال در مسیر نظم و نهادهای مستور در نظام های جامعه از قبیل نظام اجتماعی، اقتصادی، سیاسی و فرهنگی از سوی دیگر، مقبول و شایسته تحسین است. بنابراین قاعده انگاری «حفظ نظم و امنیت» در فقه شیعه با لحاظ ضرورت و قبول حسن جریان امور مردم در رساندن آنها به سعادت دنیوی و اخروی، مبتنی بر حکم ارشادی عقل و بنای خردمندان و اصطیاد از مفاد آیات و روایات معصومین(ع) است؛ زیرا مفهوم حاصل از قاعده مذکور بر دو محور اساسی دلالت دارد: نخست، نظم و نسق در حیات جمعی انسان از ضروریات اجتماعی و ضرورت های فقه شیعه است. دوم، در تشریع احکام، هیچ حکمی که بر هم زننده نظام های حاکم بر زندگی مردم باشد، وضع و جعل نشده است و در واقع، آنچه سبب به هم ریختن نظام و شیرازه زندگی و معیشت جامعه می شود، ممنوع است و کارهایی که برای صیانت و حفظ نظام جامعه ضرورت دارد، واجب است. از این رو اختلال و ناامنی در هر یک از عرصه های اقتصادی، سیاسی، اجتماعی و فرهنگی، با واسطه یا بی واسطه که به وقفه و خلأ در زندگی طبیعی و عادی بینجامد، نامشروع است و بر آن کیفر و عقوبتی مقرّر است. روش تحقیق در این مقاله، توصیفی و کتابخانه ای است؛ ابتدا به مفهوم شناسی لغوی و اصطلاحی نظم و امنیت می پردازیم و آنگاه منابع و ادلّه حاکم یا ناظر بر آنها را از فقه شیعه بررسی می کنیم.Order and Security in Shitte Fiqh as Legal and Fiqh Rule
Order and handling people’s affairs, due to people’s convergence, are among the fundamental necessities and facts of social life, which contribute to the organization of social entities and provision of security. It is required to establish order, on the one hand, and prevent any disorder and chaos, on the other hand, for the benefit of hidden entities in social, economic, political, and cultural systems. Therefore, the position of ‘protecting order and security’ in Shiite Fiqh (jurisprudence) as a rule (legal status) relies on the necessity of running public affair properly. The rule, in fact, bringing people both worldly and eternal happiness, grounds on the guideline of reason, the viewpoints of the learned, and extractions from the Holy Quran and Hadiths. The framed concept which forms the rule signifies two principles: firstly, order and discipline in humans’ communal life are among the social necessities and also the essentials in Shiite Fiqh (Fiqhi essentials). Secondly, in enaction, there exists no developed or enforced rule throwing people’s lives into chaos. In fact, anything causing chaos and disturbance at work and in life in society is banned. It is a must to take actions to provide and protect order and discipline in society. Therefore, any direct or indirect security threat or breach in any of the economic, political, social, and cultural areas, leading to an interruption or deficiency in the people’s normal and natural lives, is illegal so offenders will be penalized. This paper is a descriptive and library research. It initially works on a terminological and phraseological study of the terms ‘order’ and ‘security’. Then, it examines the literature, sources, and rules on order and security in the Shiite Fiqh.
