چکیده
زمینه و هدف: شناسایی عوامل مؤثر بر جرایم رمز ارزها در فضای مجازی است و قصد دارد با استفاده از داده های فضای مجازی دیدگاه نوینی را برای جرم یابی ارزهای مجازی بیان دارد.روش: پژوهش از نظر نوع تحقیق یک تحقیق کاربردی و از نظر شیوه اجرا از نوع روش تحقیق آمیخته با دو روش تحقیق کیفی (با تکنیک تحلیل مضمون) و روش کمی (با تکنیک پیمایشی) است. جامعه آماری بخش کیفی نخبگان و خبرگان و جامعه آماری بخش کمی کارشناسان جرم یابی رمز ارزها است. ابزارِ گرد آوری داده ها در بخش کیفی مصاحبه نیمه ساختاریافته با روش نمونه گیری گلوله برفی برای رسیدن به اشباع نظری (14 نفر) و ابزار گردآوری بخش کمی پرسش نامه است که قبل از اجرا از طریق اعتبار صوری و آلفای کرونباخ اعتبار و پایایی آن تأیید شده است. داده های تحقیق با تحلیل مضمون به روش کدگذاری و داده های بخش کمی با استفاده از نرم افزار spss مورد تجزیه و تحلیل قرار گرفتند. یافته ها: یافته های تحقیق نشان می دهد سه مقوله اصلی ساختار، تصمیم گیری و اطلاعات بر روی متغیر وابسته تحقیق یعنی جرم یابی ارزهای مجازی مؤثر است.نتایج: مهم ترین شاخصه های نظام جامع جرم یابی ارزهای مجازی، تدوین دستورالعمل و شیوه نامه های جرم یابی ارزهای مجازی بوده و رگه هایی از پول شویی در رمز ارزها و شناسایی عوامل مؤثر در فضای مجازی و عوامل جرم زای ارزهای مجازی در تحقیق به وضوح قابل مشاهده است. این موارد از عوامل مهم بی نظمی و اختلال در امنیت اقتصادی بوده و عدم انجام آسیب شناسیِ حوزه ارزهای مجازی، پیامد اقتصادی آن جبران ناپذیر بوده و جرایم پنهان ناشی از آنها منجر به کاهش تسلط سیستمِ قضایی و امنیّتی کشور بر جرم در فضای حقیقی و مجازی می شود. در نهایت از ویژگی هایِ تحقیق این است که می توان از راهکارها علیه فعالیت های غیرقانونی در این حوزه بهره برداری کرد..The pathology of cryptocurrencies with an emphasis on Bitcoin.
The purpose of this article is the pathology of crypto-currency crimes in cyberspace and it intends to use cyberspace data to express a new perspective for criminalizing virtual currencies. The current research is an applied research in terms of the type of research and a qualitative research in terms of the method of implementation and research method, with two qualitative methods of examining scientific documents and content analysis of virtual currencies. The data collection tools are scientific texts and interviews with experts and the statistical community of virtual currency experts. The research data were thematically analyzed and subjected to descriptive analysis. The findings of the research show that the three main categories of structure, decision-making and information are effective on the dependent variable of the research, i.e. the massing of virtual currencies.It is concluded that the most important indicators of the comprehensive system of criminalization of virtual currencies are the development of guidelines and guidelines for the criminalization of digital currencies, and there are traces of money laundering in cryptocurrencies and the identification of effective factors in cyberspace and criminalizing factors of virtual currencies in the research. It is clearly visible.
