چکیده
به طور کلی در بسیاری از نظام های سیاسی معاصر، اصل تفکیک قوا به عنوان یکی از شیوه های کارآمد برای اداره امور جامعه سیاسی و یکی از اصول بنیادی در قوانین اساسی کشورها پذیرفته شده است و در اهمیت این اصل بیان داشته اند که تفکیک قوا تضمینی برای امنیت و جلوگیری از استبداد می باشد. درخصوص جایگاه این اصل مهم در ساختار سازمان ملل متحد، با بررسی رابطه هر یک از سه رکن مجمع عمومی، شورای امنیت و دیوان بین المللی دادگستری به این نتیجه می رسیم که هر چند "تقسیم صلاحیت ها" در بین این سه رکن می تواند از سوء استفاده از قدرت و اختیارات اعطا شده به هر یک از این ارکان جلوگیری نماید، لکن این مهم مورد نظر مؤسسین منشور نبوده است لذا به سختی بتوان صحبت از وجود تفکیک قوا در بین ارکان سازمان ملل نمود.The Status of Separation of Powers within the United Nations System
In most of the contemporary political systems, the principle of separation of powers is recognized as an effective way for management of political and social affairs and as a fundamental principle in State constitutions. For explaining the significance of this principle, it is emphasized that the separation of powers is a guarantee for social security and preventing despotism. Regarding the role of this principle in the UN structure, assessing the relation between three pillars of the UN, i.e. the General Assembly, the Security Council and the International Court of Justice, it will be understood that although enforcement of this principle among these three organs can prevent the misuse of power dedicated to these organs, but this was not meant by those who established the UN charter and it is hard to speak about the existence of separation of powers in the UN system.
