بررسی حقوق جهانگرد در نظام حقوقی اسلام و ایران و مقایسه آن با اسناد بین المللی (مقاله علمی وزارت علوم)

چکیده
پژوهش حاضر در صدد بررسی حقوق جهانگرد در نظام حقوقی اسلام و ایران و مقایسه آن با اسناد بین المللی است. از این منظر پس از بسط فضای مفهومی موضوع، به بررسی حقوق جهانگرد خواهد پرداخت. در این پژوهش، روش تحقیق، توصیفی-تحلیلی و روش گردآوری اطلاعات، کتابخانه ای می باشد آنچه ضرورت و اهمیت این مقاله را نشان می دهد این است که ایران علیرغم پتانسیل های بالای جذب توریسم نتوانسته در این زمینه موفق عمل کند و بخش مهمی از این موضوع به ضعف قوانین و حقوق جهانگردی در ایران بر می گردد که بسیار کلی، مبهم، فاقد ضمانت اجرایی بالا و برخورداری از عدم تخصص هستند. در ادامه این سوال مطرح است چه حقوقی را می توان برای جهانگرد در نظام حقوقی اسلام و ایران را برشمرد؟ یافته های پژوهش حاکی از آن است که، آزادی عقیده و مدارا ، حفاظت از جان، مال و اموال، حق امنیت، مصونیت از ظلم و ستم از جمله حقوق مشترک جهانکرد در دو نظام حقوق ایران و اسلام می باشند. نتیجه بدست آمده در این مقاله این است که اولا، در مقایسه حقوق جهانگرد تفاوت چندانی میان فقه اسلامی و قانون موضوعه ایران وجود ندارد اما در حوزه تعیین مصادیق حقوق جهانگرد، حقوق ایران از فقه اسلامی تاثیر پذیرفته است. ثانیا، در مقایسه با اسناد بین المللی، موانع حقوقی بسیاری از جمله برداشت نادرست از قانون اساسی، عدم تضمین های لازم به جهانگرد و عدم استاندارد سازی قوانین با ساختارهای بین المللی در قوانین موضوعه ایران دیده می شود.Study of tourist rights in the legal system of Islam and Iran and its comparison with international documents
The present study seeks to study of tourist rights in the legal system of Islam and Iran and its comparison with international documents. From this perspective, after expanding the conceptual space of the subject, shall be study the rights of tourists. In this research, the research method is descriptive-analytical and the method of collecting information is libraries. What shows the necessity and importance this article, This is it; Iran despite its high potential for attracting tourism, it has not been able to succeed in this field and an important part this issue goes back the weakness tourism laws and rights in Iran which are very general, vague, lack high executive guarantees and lack of expertise. Then the question arises what rights can be enumerated for the tourist in the legal system of Islam and Iran? The research findings indicate that Freedom of opinion and tolerance, protection of life, property, right to security, and protection from oppression are among the common rights of Tourist in the two legal systems of Iran and Islam. The result of this article is that first, there is not much difference between Islamic jurisprudence and Iranian law in comparing tourist law , but in the field of determining examples of tourist rights, Iranian law has been influenced by Islamic jurisprudence; secondly, compared to international documents ,many legal obstacles, such as misinterpretation of the constitution, lack of necessary guarantees for tourists, and lack of standardization of laws with international structures are seen in the relevant Iranian laws.
