چکیده
وحید بهبهانی (م 1205ق) یکی از مجتهدان بسیار بزرگ قرن دوازدهم هجری است که در سالهای نخست قرن سیزدهم درگذشت. از وی میراث گرانبهایی در فقه و اصول برجای مانده، به علاوه، شاگردان بزرگی که برخی از آنان در شمار بزرگترین مجتهدان قرن سیزدهم هجری هستند، تربیت کرد. و مهم تر از همه در حیات فکری او این است که جریان اخباری را که در قرن دوازدهم بر بیشتر حوزه های شیعه غلبه کرده بود شکست داد. بخشی از آثار وی سوال و جواب های فقهی هستند که از آنها با عنوان استفتاءات تعبیر می شود. این سوال و جوابها حاوی اطلاعات اجتماعی و فرهنگی و تمدنی است، و به علاوه، روی پاره ای از مفاهیم کلیدی تأکید می کند که در شناخت مذهب و روش فهم آن اهمیت دارد. مقاله حاضر، بر اساس یکی از این مجموعه استفتاءات نوشته شده و منتخبی از آنها را ارائه کرده است.Reading Manuscripts (39): Some Valuable Jurisprudential and Social Inquiries from the Late 12th Century Hijri by the Renowned Scholar Waḥīd Behbahānī (1118–1205 AH)
Waḥīd Behbahānī (d. 1205 AH) was one of the most prominent jurists of the 12th century Hijri, who passed away in the early years of the 13th century. He left behind a significant legacy in jurisprudence and principles and trained many distinguished students, some of whom are among the most notable jurists of the 13th century Hijri. Most importantly, in his intellectual life, he defeated the Akhbari movement that had dominated most Shiite seminaries during the 12th century. Some of his works are collections of jurisprudential questions and answers, known as Istiftā'āt. These questions and answers contain social, cultural, and civil information and emphasize certain key concepts crucial for understanding the religion and its interpretive methods. This article is based on one of these collections of Istiftā'āt and presents a selection from them.
