چکیده
جهانی شدن مقیاس سازمان فعالیت های گوناگون بشر را دگرگون کرده است، برخلاف عصر پیشامدرن با شتاب گرفتن جهانی شدن جوامع دیگر در حصار مرزهای خود منزوی نیستند، بلکه تامین ضرورت های زندگی سبب گسترش ابعاد فعالیت های اشخاص در مقیاس وسیع تر جهان شده است، بر این اساس همان طوری که عرصه و قلمرو فعالیت و کنش بازیگران گسترش می یابد بشر به چارچوب های حقوقی فراتر از مرزهای دولت های ملی نیاز پیدا می کند، در این مقاله به روش توصیفی تحلیلی به بررسی تاثیر جهانی شدن بر روند یکسان سازی قواعد و قوانین ورای مرزهای ملی کشورها پرداخته شده است و در همین راستا سؤال اصلی این مقاله آن است که جهانی شدن چه تاثیری بر روند حقوق ملی دولت ها دارد؟ و در پاسخ این فرضیه طرح می شود که جهانی شدن سبب شکل گیری روند یکسان سازی قواعد حقوقی در زمینه های مختلف حقوقی در جهت تعدیل تعارض منافع شده است. جهانی شدن گرچه ریشه های تاریخی دارد اما شتاب و گسترش آن مربوط به قرن بیستم و بویژه پس از فروپاشی شوروی و پایان عصر جنگ سرد است. که به نیرویی برای گسترش قواعد جهان شمول ورای مرزهای ملی بدیل شده است.Globalization and the process of unification of rules beyond modern national systems
Globalization has changed the scale of the organization of various human activities, unlike in the pre-modern era, with the acceleration of globalization, societies are no longer isolated in the fence of their borders, but providing the necessities of life has led to the expansion of the dimensions of people''s activities on a wider scale of the world. This basis, as the field and scope of actors'' activities and actions expands, mankind needs legal frameworks beyond the borders of national governments, in this article, in a descriptive and analytical way, the impact of globalization on the process of unification of rules and laws is investigated.It has been discussed beyond the national borders of the countries, and in this regard, the main question of this article is what effect does globalization have on the process of the national rights of the states? And in response to this hypothesis, globalization has caused the formation of the process of unification of legal rules in different legal fields in order to moderate the conflict of interests. >Although globalization has historical roots, its acceleration and expansion is related to the 20th century, especially after the collapse of the Soviet Union and the end of the Cold War era. which has become a force for the expansion of universal rules beyond national borders.
