چکیده
حق بر صلح و حق بر محیط زیست هر دو در نسل سوم حقوق بشر، یعنی در حق بر همبستگی گنجانده می شوند. تعامل صلح و محیط زیست تعاملی دوسویه است، زیرا گاه صلح حامی محیط زیست می شود و گاه محیط زیست حامی صلح که در نهایت نقطه تلاقی این دو صلح سبز است. بدین سان لازم است که نحوه این تعامل و ساز و کارهای رسیدن به صلح سبز در نظام آموزش عالی کشورها نهادینه شود تا هر چه بهتر در راه حفاظت از محیط زیست گام برداشته شود. پرسشی که مطرح می شود این است که در نظام آموزش عالی کشور ایران در رشته حقوق، به چه میزان حق بر صلح زیست محیطی نهادینه شده است و تا چه حد باید پیش رود؟ در پاسخ باید بیان داشت که در برنامه درسی گرایش های مختلف رشته حقوق در مقطع تحصیلات تکمیلی، در مجموع در سه گرایش حقوق محیط زیست، حقوق بشر و حقوق بین الملل به مسئله صلح زیست محیطی توجه شده است. در گرایش حقوق محیط زیست(مقطع کارشناسی ارشد) درسی با عنوان «حقوق بشر و محیط زیست» وجود دارد که از سرفصل های اصلی آن به حق بر صلح و محیط زیست اختصاص داده شده است. در گرایش حقوق بشر(مقطع کارشناسی ارشد) درس «حقوق همبستگی» با پیش بینی حق بر صلح وجود دارد و در گرایش حقوق بین الملل نیز(مقطع کارشناسی ارشد و دکتری) درس «حقوق بین الملل اسلام» و «حقوق بشر» در همین راستا به امر حفظ صلح و امنیت جمعی بین المللی اختصاص یافته اند. در این پژوهش تلاش شده است که جایگاه صلح سبز در نظام آموزش عالی ایران بررسی شود.The position of green peace in Iranian higher education system
The right to peace and the right to the environment are both included in the third generation of human rights, the right to solidarity. The interaction of peace and the environment is a two-way interaction, because sometimes peace is the environment and sometimes the environment is the peace, which is ultimately the intersection of the two green peace. It is therefore necessary to institutionalize how these interactions and mechanisms for achieving green peace in the higher education system of the countries are to be taken in order to better protect the environment. The question that arises is, to what extent is the right to environmental peace institutionalized in Iran's higher education system, and to what extent should it proceed? In response, it should be noted that in the curriculum of the various trends in law at the postgraduate level, the environmental peace, human rights and international law trends are generally addressed in three areas. In the field of environmental law (MA) there is a course entitled "Human Rights and the Environment" devoted to the right to peace and the environment. In human rights (MA) there is a solidarity law with the right to peace, and international law (MA and PhD) in Islamic International Law and Human Rights. International peacekeeping and collective security are dedicated. This study attempts to investigate the position of green peace in Iranian higher education system.
