بررسی فقهی و حقوقی سلب امنیت شهروندی در هوش مصنوعی (مقاله علمی وزارت علوم)

چکیده
نوشتار حاضر در رابطه با دخالت هوش مصنوعی در امنیت و حقوق شهروندی است. این موضوع می تواند در جهات مختلف مورد بررسی قرار گیرد، مانند ایجاد امنیت توسط هوش مصنوعی در حقوق شهروندی، سلب امنیت شهروندان به وسیله ی هوش مصنوعی، ارائه راهکار جبران خسارت در سلب حقوق شهروندی توسط هوش مصنوعی. در این مقاله تنها به موضوع سلب امنیت شهروندان اشاره شده و دو موضوع دیگر مقاله ای مستقل می طلبد. روش کار در این تحقیق، بر مبناء تحلیل محتوا بوده و داده ها به صورت کتابخانه ای با مراجعه به آراء فقهی و حقوقی جمع آوری گردید. بزه کاران با استفاده از هوش مصنوعی می توانند اقدام به سلب امنیت و حقوق شهروندان نمایند، از آنجا که در کشور ما قانون خاصی برای جرائم در هوش مصنوعی وجود ندارد و بعضی می اندیشند جرائم رایانه ای می تواند پاسخگوی موضوع حاضر باشد در حالی که چنین نیست، لذا نگارندگان با تنقیح مناط و بهره گیری از ادله شرعی به موضوع جرم انگاری در سلب امنیت و آسایش شهروندان پرداخته اند. نتیجه ی حاصله از تحقیق آن که سالب امنیت و آسایش شهروندان با استفاده از ابزار هوش مصنوعی محارب و مفسد فی الارض است و در صورت اقدام به آن مستحق اعمال مجازات محارب خواهد بود.Jurisprudence and legal review of citizenship security deprivation in artificial intelligence
This article is related to the involvement of artificial intelligence in security and civil rights. This issue can be investigated in different directions, such as creating security through artificial intelligence in citizenship rights, depriving citizens of security through artificial intelligence, providing a compensation solution for depriving citizenship rights through artificial intelligence. In this article, only the issue of deprivation of citizens' security is mentioned, and the other two issues require an independent article. The working method in this research is based on content analysis and the data was collected in a library form by referring to jurisprudence and legal opinions. Criminals can use artificial intelligence to take away the security and rights of citizens, since there is no special law for crimes in artificial intelligence in our country, and some people think that computer crimes can be the answer to the present issue, while this is not the case, so the authors have addressed the issue of criminalization in depriving the security and comfort of citizens by revising Manat and using Sharia evidence. The result of its investigation is that it is harmful to the security and comfort of the citizens by using artificial intelligence tools, and if it is done, it will be punished.
