گواهی بکارت؛ جدال اندیشه ها در مبانی فقهی (مقاله علمی وزارت علوم)

چکیده
فقه عرصه مصاف اندیشه هاست. یکی از موضوعاتی که اندیشه فقهی آن را به چنگ فهم خود درآورده است مفهوم باکرگی است؛ مفهومی که اندیشه های فقهی در باب مبانی جواز یا عدم جواز اخذ گواهی برای آن رویاروی یک دیگر قرار گرفته اند. این پژوهش با روش توصیفی تحلیلی بیان می کند که برخی از فقها با استناد به قاعده «تسلیط، التعیین بالعرف کالتعیین بالنص» و نیز قاعده ضرورت قائل به جواز اخذ گواهی بکارت شده اند. این در حالی است که تمسک به قواعد یادشده برای اثبات موجه بودن اخذ گواهی بکارت با چالش های نظری بسیار روبه روست. دیدگاه فقهی دیگری که این نوشتار قدرت و قوت دلایل مورد استناد آن را در ترازوی ارزیابی به محک سنجش درآورده است بر عدم جواز اخذ گواهی بکارت پای می فشارد. حرمت نگاه و لمس عورت مستحکم ترین دلیل فقهی برای عدم جواز است. قاعده لاضرر نیز به عنوان یکی از پرکاربردترین قواعد فقهی به کمک اثبات عدم جواز اخذ گواهی می آید. به علاوه اخذ گواهی بکارت از دختر خلاف عدالت و ناقض کرامت انسانی است.Virginity Certificate; Conflict of Ideas in the Area of Principles of Jurisprudence
Jurisprudence is the area of conflicting ideas. One of the subjects grasped by jurisprudence is the concept of virginity; a concept for which jurisprudential thoughts have faced each other regarding the basis of the permissibility or non-permissibility of obtaining a certificate. This research, using the descriptive-analytical method, states that some jurists, relying on the rule of dominance, the rule of appointment by custom is like appointment by text, and also the rule of necessity, hold that obtaining the certificate of virginity is permissible. At the same time, resorting to the above-mentioned rules to prove the validity of obtaining a virginity certificate is facing many theoretical challenges. Another jurisprudential point of view, which this article has tested the strength of the cited reasons in the evaluation scale, insists on the impermissibility of obtaining a virginity certificate. The forbiddence of looking and touching pudendum is the strongest jurisprudential reason of impermissibility. No-harm (la-zarar) rule is one of the most widely used jurisprudential rules to prove the impermissibility of obtaining a certificate. In addition, obtaining a virginity certificate from a girl is against justice and violates human dignity.
