تحلیل فقهی وحقوقی تظاهر به افعال حلال با تاکید برنظام حقوقی ایران (مقاله علمی وزارت علوم)

چکیده
تظاهر به افعال حلال امری اعتباری و نسبی اند که با افکار، عقاید، آداب و اخلاق مردم هرجامعه اتباط مستقیم دارند که جرم، کژروی یا حتی هنجاردانستن آن بستگی به جامعه ای دارد که درآنجا به وقوع می پیوندد. البته قانونگذار ایران این رفتار را مغایر با اصول و مبانی اخلاقی جامعه دانسته و ملاک جرم شناختن این رفتار را جریحه دار شدن عفت عمومی ای که در واقع مخدوش کننده ی نظم اجتماعی جامعه است می داند و بدون در نظرگرفتن اقدامات غیرکیفری با ضمانت اجرای قهرآمیزکیفری به مقابله با آن می پردازد. البته اقدامات غیرکیفری در مقابله با تظاهربه فعل حلال در اولویت قراردارد و صرف قابلیت تعزیر و همچنین غیراخلاقی بودن تظاهربه فعل حلال، دلیل ضرورت جرم انگاری آن درحوزه حقوق کیفری نمی باشد. چرا که می توان از طریق فرهنگ سازی و اقدامات غیرکیفری، رفتار مورد نظر را محدود و با آن مقابله کرد. اما اگر اقدامات غیرکیفری نتیجه بخش باشد در صورتی تظاهر به فعل حلال قابلیت جرم انگاری دارد که مقابله کیفری باعث کاهش این رفتار در جامعه شود و منافعی که از جرم انگاری آن عاید جامعه می شود در مقایسه با آثار منفی آن بیشتر باشد. اما قانونگذا ایران ضمن جرم انگاری این رفتار، روی گرداندن از اقدامات غیر کیفری است و بدون پشتوانه جرم انگاری تمایل به اقدامات قهرآمیزکیفری دارد که البته می توان با فرهنگ سازی و آموزش برنامه های تربیتی و همچنین با احیای سنت حسنه امربه معروف و نهی ازمنکر دامنه این رفتار را محدود کرد.Juridical Analysis with Emphasis on the Legal System of Legal Pretense of Lawful Acts
Demonstration of lawful verbs is a credit and affair that is directly related to the thoughts, beliefs and morals of the people in any society whose crime, punishment or even the norm of what they know, depends on society. Of course, the Iranian legislator considers this behavior to be contrary to the ethical principles of the society and considers the criterion of criminalizing this behavior to be a victim of public humiliation which is in fact a disturbance of the social order of society.And, without regard to non-criminal acts, it deals with the guarantee of coercive punishment .The criminal actions is against lawful act pretending to prioritize and spend chastising capabilities and immoral act of pretending to be lawful, because necessity is not criminalized in the field of criminal law.It can be through culture and non-criminal actions and desired behavior is limited. And interest to income from the criminalization of the society will be greater than the negative effects. The legislature of the criminalization of this behavior turned from non-criminal acts, without violent criminal acts. It can be determined by culture and education of anytraining programs.
