چکیده
دخالت فهم عرف در استنباط احکام امری مسلم و روشن است، اما مرز این دخالت از حیث عملی همواره مبهم و مورد بحث فقهاء بوده است، به ویژه زمانی که قضاوت عرف در مورد مفهوم واژه ها در آیات و روایات و نیز مراد شارع از ترکیب ادلّه لفظی، با نصوص و ظهور بدوی آیات و روایات مغایر باشد، یا زمانی که نظر عرف در مصداق یابی واژه ها و نیز تعمیم و تضییق حکم، با نصوص و دلالت صریح آیات و روایات همخوانی ندارد، این ابهام با توجه به تضارب آراء در این موارد، بیشتر نمود دارد. در این پژوهش با روش توصیفی تحلیلی و نظر به مسلمات فقه امامیه درحوزه کاربرد و میدان عمل عرف، هشت مورد از موارد ممکن الوقوع تعارض عرف با آیات و روایات فقهی شناسایی شده و با طرح راه های برون رفت، سعی دارد نهایتاً به ضابطه روشنی برای حل تعارض دراین موارد دست یابد.Conflict of Custom with Verses and Jurisprudential Quotations and Solutions
The intervention of perceiving custom in commands inference is a clear and definite issue; however, limit of this intervention in practice has always been a vague subject of jurisprudential arguments; especially when custom judgment comes into conflict in distinguishing the concepts of the verses and quotations and the purpose of legislator on combining the verbal arguments with the initial wordings of verses and quotations; or when the decision of custom in conformity of concepts on the attributes, generalizing and restriction of the evidence context do not comply with the texts; in which case, the ambiguity has more manifestations. In this research that is made by an analytical-descriptive method in view of the definitions of Imamieh Jurisprudence in the range of application and practice of custom, eight cases of potential conflicts with jurisprudential verses and narrations have been identified.
