چکیده
با توجه به اهمیت دلیل عقل در استنباط احکام شرعی به ویژه در مسائل نو، بررسی آثار فقها در استفاده از دلیل عقل به استفاده بهتر از دلیل عقل کمک می کند. بررسی سیره فقهی محقق حلی به عنوان فقیهی مؤثر در تکامل فقه در اثبات این مسأله شایسته است. بدین منظور بررسی متون فقهی استدلالی و اصولی وی مورد بررسی قرار گرفته است. نتیجه تحقیق نشان می دهد وی در استفاده از دلیل عقل نخست بر لزوم اتباع از کتاب و سنت پرداخته است. او دلیل عقل را به عنوان تشریع کننده مستقل وجوب و حرمت پذیرفته که در مواردی به یاری دلیل شرع این وظیفه را انجام می دهد و دلیل عقل را درک کننده حکم خطابی شارع دانسته، از آن به عنوان مخصص عمومات شرعی نیز بهره برده است. محقق حلی به دلیل عقل نقش اثبات کننده حجیت سایر ادله چون خبر واحد را نیز داده است. همچنین اصل عملی استصحاب در نظر او یک دلیل عقلی شمرده شده است.Reason of the Wisdom (Dalile Aaqhl) and its Status on the Deductive Manner of Mohaghegh Helli
Given the importance of the reason of wisdom (Dalile Aghl) in inferring legal rulings, especially in new issue, examining the reason of wisdom would help a better use of the reason of wisdom. Examining the deductive manner of Mohaghegh Helli as an influential jurist in development of jurisprudence is befitting and praiseworthy in proving this issue. For this purpose, his discursive and theological (Usuli) legal texts have been examined on the basis of content analysis method and his legal judgments have been examined one by one. The results of the research indicate that Mohaghegh Helli has used the reason of wisdom for proving the necessity of the book (Quran) and tradition obedience.
