چکیده
حج تمتع بر هر مسلمانی، در صورت استطاعت مالی و سلامت جسمی واجب است و در این باره تبعیض جنسیتی وجود ندارد. طواف یکی از مهم ترین احکام حج است که مستلزم طهارت طواف کننده است. این پژوهش به روش تحلیلی توصیفی انجام شده و در صدد پاسخ دهی به این سؤال است که تکلیف طواف بانوانی که در حین طواف درگیر عادات ماهیانه می شوند، چیست؟ در این باره نظرات مختلفی مطرح است. در بررسی انجام شده مشخص شد که فقهای امامیه معتقدند اگر چهار دور طواف انجام داده باشد، باید طواف را ادامه دهد؛ در غیر این صورت باید از آن عدول کند. اما شیخ صدوق معتقد است مطلق طواف صحیح است و ابن ادریس بر باطل بودن آن عقیده دارد. در این پژوهش، ضمن واکاوی هر نظریه، حکم کلی این مهم استخراج می شود. چنین به نظر می رسد که با توجه به قداست عمل حج، اگر عدول از آن میسر نباشد، نباید این عمل مقدس را نیمه کاره رها کرد؛ اما در عین حال همین قداست بیان می دارد که افراد ناپاک نباید در این عمل مقدس حضور یابند.The Analysis of the Legitimacy of Women’s Ṭawāf in Ḥajj al-Tamattuʿ, during Their Menstruation
If a Muslim can afford it and is physically sound, performing Ḥ ajj al-Tamattu ʿ is obligatory, and there is no gender discrimination in this respect. Ṭ aw ā f is one of the most essential rites of Hajj, requiring that pilgrims performing ṭ aw ā f be purified. This study used an analytical-descriptive approach to answer this question: What is the responsibility of women who get menstruation during ṭ aw ā f ? There are several points of view. According to the findings of this research, Imamiyyah jurists think that if a woman completes four rounds of her ṭ aw ā f , she should continue doing so; otherwise, she should avoid it. Sheikh Saduq believes in the absolute validity of her ṭ aw ā f but Ibn Idrīs believes in its invalidity. In this research, while analyzing each viewpoint, the general rule of this important issue is extracted. Given the sanctity of the practice of Hajj, if deviation from it is not possible, it should not be abandoned; but at the same time, this sanctity states that unpurified people should not perform this holy practice.
