چکیده
با پیشرفت تکنولوژی، صنعت و ارتباطات، در پاره ای از معاملات، پول سنتی و مجازی جای خود را به رمزارز داده است. ازآنجایی که رمزارزها نوپدید هستند، لذا تطبیق احکام فقهی و حقوق اسلامی بر آن با مشکلاتی چند روبه روست. یکی از مسائلی که در این حوزه قابل واکاوی و محل تأمل می باشد، استخراج رمزارز است. مستخرج تحت چه سببی از اسباب تملک، مالک آن می گردد آیا می توان استخراج را مصداقی از حیازات مباحات دانست؟ این نوشته که به شیوه تحلیلی توصیفی و با روش اجتهادی فقه محور نگاشته شده، به این نتیجه رسیده که اگر رمزارز را مصداقی از مباحات بالعرض بدانیم می توانیم عملیات استخراج رمزارز را در قالب حیازات مباحات تحلیل نماییم؛ ازاین رو فرد مستخرج به سبب عمل ماینینگ اقدام به حیازت آن کرده و در نتیجه مالک آن می شود. در رفع این اشکال که تحقق و موجودبودن مال، شرط برای تحقق حیازت است، این گونه پاسخ داده شده که موجودیت بالفعل مال شرط برای تحقق و صحت ملکیت به سبب حیازت نیست و از طرفی رمزارز در فرایند استخراج سایر شرایط مالیت مجاز را دارا می باشد.Jurisprudence-legal examination of cryptocurrency mining as an example of acquisition of unclaimed property

This writing is written in a descriptive-analytical way and with a fiqh-oriented ijtihad method; It has come to the conclusion that on the basis that we consider the currency as an example of the free speech, we can analyze the operation of extracting the currency in the form of possession of the speech, therefore, the miner has taken possession of it due to the mining process and as a result, the owner it becomes In order to solve this problem that the existence of the property is a condition for the realization of possession, it has been answered that the actual existence of the property is not a condition for the realization and authenticity of the property, and on the other hand, the cryptocurrency in the process of extraction has other conditions of permissible ownership.
