تاملّی فقهی پیرامون استثناء زوجین از ارث بردن حد قذف (مقاله علمی وزارت علوم)

چکیده
حد قذف یکی از حدود شرعی است که در مواد قانونی نیز بدان پرداخته شده و در ماده ی 260 ق.م.ا مصوب 1392 بحث ارث رسیدن حد قذف به ورثه مقذوف و استثناء زوجین از ارث بردن حد قذف مطرح شده است. باتوجه به اینکه فقها و قانونگذار جمهوری اسلامی ایران زوجین را از ارث بردن قذف محروم دانسته اند هدف اصلی این پژوهش بررسی ادلّه فقهی استثناء شدن زوجین از ارث بردن حد قذف است؛ البته به عنوان نکته مقدماتی دیدگاه فقها در مورد اصل حکم به ارث رسیدن حد قذف نیز بررسی شده است. این پژوهش با استفاده از منابع فقهی و روایی با نگاهی انتقادی به دیدگاه فقها و قانونگذار در زمینه استثناء زوجین از ارث بردن حد قذف سامان یافته است. آنچه به عنوان نتیجه مطرح شده، با توجه به عمومات به ارث رسیدن حد و نبود دلیل برای استثناء زوجین، استثناء مذکور در کلام بسیاری از فقها و ماده ی 260 ق.م.ا بدون پشتوانه و نادرست به نظر می رسد. در پایان با توجه به این نتیجه، پیشنهادی در زمینه تغییر متن ماده ی 260 ق.م.ا ارائه شده است.A Jurisprudential Study on the Exclusion of Spouses from the Inheritance Procedure in the Case of Prescribed Punishment of Qadhaf
Qadhaf is one of the Shariatic prescribed punishment which is also covered in the law. Article 260 of the Iranian Civil Code, adopted in 2013, stipulates that the heirs of the extruder from the libel limit exclude the couple from inheriting the libel. The main objective is to study the jurisprudential evidence of the exclusion of the couple from inheritance by defamation; of course, we have studied the views of jurists as a preliminary observation in this regard. This study was written using both jurisprudential and narrative sources and with a critical view of the views of jurists and legislators in the same law of inheritance procedure. In view of the characteristics of the inheritance procedure and the lack of evidence to exclude the couple, we conclude in this study that this article appears to be unsupported and incorrect. At the end of this study and in view of this finding, we have made suggestions to amend the article of the Iranian Civil Code.
