چکیده
مالکیت از جمله حقوق مسلم اشخاص بوده که در تمامی کشورها مورد حمایت و احترام می باشد. امروزه رابطه دانش و تجارت بیش از پیش مورد توجه قرار گرفته و اموال معنوی نقش مهم و حیاتی در روابط میان افراد حقیقی و حقوقی پیدا نموده است از مباحث حقوق مالکیت معنوی بررسی مبانی و نحوه انتقال آن می باشد. فقها درباره ی حقوق مالکیت معنوی به اظهار نظر پرداخته اند. برخی در مخالفت و عدم مشروعیت حقوق یادشده سخن گفته و به ارائه ی دلیل پرداخته اند و برخی نیزآن را مشروع دانسته اند و راه های انتقال آن را بیان نموده اند. در حقوق ایران نیز مبانی این حقوق مورد بحث قرار گرفته ولی به نحوه و جواز انتقال اموال معنوی تصریح نشده است اما از برداشت ها و نبود موانع عمده، بعضا در اموال فکری و عمدتاً در اموال صنعتی، مشخص گردید که در برخی موارد امکان انتقال وجود دارد و در سایر موارد نیز با وضع قوانین امکانپذیر خواهد شد. در این نوشتار حقوق مالکیت معنوی و مبانی آن مورد بررسی قرار خواهد گرفت.The intellectual Property Rights in the Shiite Jurisprudence and Statutes of Iran
Property is one of the definite individual rights which is respectable all over the world. Nowadays the relation between science and trade is more attractive, so intellectual properties achieves vital role in the relation between individuals and legal entities. One of the most important sections in intellectual property rights is its foundation and assignment. Jurists comment on intellectual property rights. Some of them disagree and indicate that is illegal according to some reasons, while some others recognize it completely legal and declare its assignment. In Iran there are some discussions about this kind of right but the solutions for assignment of intellectual right is not determined. However, there are some comprehensions which emphasize there are some solution for its assignment in some intellectual properties and mainly in industrial properties and in other cases it will be feasible by making laws. In this research intellectual property rights and its fundamental will be investigated.
