چکیده
هدف از این مقاله ارزیابی لایحه اصلاح قانون مستثنیات دین و شمول آن بر مستمری مددجویان کمیته امداد امام خمینی(ره) و سازمان بهزیستی است. در مقاله حاضر تلاش شده تا آرای فقها درباره مستثنیات دین مورد بررسی قرار گرفته و ضابطه کلی در خصوص تعیین مصادیق آن معلوم شود تا در پرتو آن مشخص گردد که دارابودن این ضوابط می تواند با توجه به مقتضیات زمان، مصادیق این عنوان را تعمیم دهد به طوری که مستمری مذکور را نیز در برگیرد. اما این امر دلیل بر پذیرش و لزوم تصویب این لایحه در مجلس شورای اسلامی نیست. نتایج مقاله حاکی از آن است که تصویب این لایحه اثراتی منفی داشته و در برخی موارد باب شبهه را نیز خواهد گشود.The Bill of Civil Law Reform in Religious Exceptions and its Inclusion on Imam Khomeini Committee Clients' Pension and Welfare Organization
The purpose of this study is to assess the bill of civil law reform in religion exceptions and its inclusion on Imam Khomeini committee clients' pension and welfare organization. In the present study it was tried to examine the jurists' viewpoints about debt exceptions and to determine the general principles regarding their indications, so that it is justified whether such principles according to an era could be generalized in a way that include the aforesaid pension. However, this action does not necessarily lead to acceptance and approval of such bill in Islamic Parliament. The results of this paper show that the approval of this act has negative effects and it may open doubt s in some cases.
