چکیده
دامنه واکنش به پدیده پولشویی و تأمین مالی تروریسم و تکثیر تسلیحات کشتارجمعی دارای ابعاد جهانی است و باتوجه به عکس العمل های متفاوت جامعه بین المللی که از طریق سازمان های منطقه ای و جهانی به وقوع پیوست، سیاست های حقوقی گروه ویژه زودتر از آنچه که تصور می رفت، در حوزه حقوق داخلی و بین المللی و مراجع بین المللی بازتاب یافت. در این میان آنچه که جامعه بین المللی نسبت به آن وحدت نظر پیدا کرد، این بود که نبرد علیه پولشویی و تأمین مالی تروریسم و تکثیر تسلیحات کشتارجمعی جز از طریق و روش های نظام مند در عرصه بین المللی مقدور نیست. گروه ویژه به عنوان تجلّی اراده دولت ها و بسیج عمومی جامعه جهانی درجهت ریشه کن ساختن پدیده های مزبور به شمار می رود. نقش و جایگاه گروه ویژه در این راستا به مثابه یک سازمان بین المللی، همواره موردبحث و مناقشه در حوزه حقوق بین الملل بوده است. نویسندگان در پی اثبات این فرضیه اند که گروه ویژه یک سازمان بین المللی با قلمرو جهانی است و نقش، جایگاه و توصیه های آن با حقوق بین الملل و حقوق بین الملل عرفی مطابقت دارد.The role & position of FATF in international law system
The Role &Position of FATF in International law System<br />Abstract<br />The range of responses to the phenomenon of money laundering , terrorism financing and the proliferation has a global dimension and given the diverse reactions of the international community through regional and global organizations, the legal policies of the FATF sooner than previously thought were reflected in domestic and international law and international community. In the meantime, the international community has come to the conclusion that the international fight against money laundering, terrorist financing and proliferation of weapons of mass destruction is only possible through systematic means. FATF is the center of expression of the will of governments and the international community to eradicate these phenomena. The role and position of the FATF in this regard as an international organization has always been controversial in the field of international law.<br />The authors seek to prove this assumption that the FATF is an international organization with a global scope and that its role, position and the recommendations complying with international and customary law.
