چکیده
بند نخست اصل 85 قانون اساسی ایران با شرایطی از جمله «موارد ضروری» و «بعضی از قوانین» تقنین آزمایشی را تجویز نموده است؛ شیوه ای از قانونگذاری که قیود آن تا پیش از نظر مورخ 1389/10/28 شورای نگهبان در خصوص لایحه «تشکیلات و آیین دادرسی دیوان عدالت اداری» مورد استفاده شورا قرار نگرفته و این نهاد، تشخیص مجلس در موضوع «موارد ضروری تصویب قوانین آزمایشی» را پذیرفته بود؛ امّا شورا با نظر مذکور که در لوایح «امور گمرکی» (نظر 1390/2/15) و «تجارت» (نظر 1391/2/24) نیز تکرار شد، تفسیر این مهم را در صلاحیت خود و تشخیص مجلس را در چهارچوب «مغایرت با اصل 85» رد نموده است. نظری که در این نوشتار در گستره مبانی تقنین آزمایشی و کارویژه شورای نگهبان در این مورد، با تأکید بر لایحه دیوان عدالت اداری مورد واکاوی قرار گرفته و برآیند نهایی نگارنده از رویکرد تفسیری شورا نسبت به تقنین آزمایشی در این سه لایحه، مغایرت با کارویژه دادرسی اساسی این نهاد و ورود به مصلحت اندیشی تقنینی است.An analysis on interpretation of guardian council about Experimental Laws in three bills of “organization and procedure of Court of Administrative Justice”, “customs affairs” and “commercial”
The first paragraph of principle 85 of constitution of Islamic Republic of Iran has prescribed experimental legislation with some conditions such as “necessary points” and “some rules”. A method of legislation that its clauses were not used by the council until the opinion of guardian council on 18/1/2011 concerning the act of “Court of Administrative Justice” and this council had accepted opinion of parliament about essential cases for approval of experimental laws. However the council has repeated this issue in acts of “customs affairs” (opinion dated 5/5/2011) and “commercial” (opinion dated 13/5/2012) and again has rejected opinion of parliament. The idea mentioned in this writing in the field of basics of experimental legislation, function of guardian council in this regard and act of Court of Administrative Justice. To conclude, the final result of article is that interpretation of guardian council about experimental legislation in 3 bills that said, in contradiction to the function of this council.
