برای ارزیابی عملکرد علمی دانشگاه ها می توان از شاخص های علم سنجی استفاد کرد. «شاخص اثر متیو»، معرفی شده توسط رابرت ک. مرتون، از جمله شاخص های اجتماعی علم سنجی است که با تبیین نابرابری میان پژوهشگران، به بررسی میزان انتشارات و استنادات می پردازد. با بهره گیری از رابطه Power-law، می توان تاثیر شاخص اثر متیو را بر تولیدات علمی دانشگاه های علوم پزشکی بررسی نمود. همچنین، می توان شاخص دیگری با نام «شاخص مستقل از مقیاس» را برای نرمالیزه کردن رتبه بندی دانشگاه ها به کار برد. هدف از این پژوهش، بررسی تاثیر «اثر متیو» بر کمیت (انتشارات) و کیفیت (استنادات) تولیدات علمی دانشگاه های علوم پزشکی ایران در فاصله زمانی 2002-2006 بوده است. این پژوهش توصیفی- تحلیلی با استفاده از شاخص اثر متیو و رابطه Power-law انجام شده است. منبع گردآوری داده ها، پایگاه WOS و جامعه آماری، 6347 مدرک نمایه شده دانشگاه های علوم پزشکی ایران در فاصله زمانی 2002-2006 در این پایگاه بوده است؛ استنادات نیز از JCR استخراج گردیده است. نتایج نشان داد که رابطه غیرخطی (Power-law) میان تولیدات علمی و استنادات دانشگاه های علوم پزشکی ایران برقرار بوده است. اثر متیو بر تولیدات علمی تمامی دانشگاه های علوم پزشکی، دانشگاه های تیپ یک و سایر دانشگاه ها تاثیر مثبت و بر تولیدات علمی دانشگاه های تیپ دو و سه تاثیر منفی داشته است. دانشگاه علوم پزشکی تهران اولین رتبه و دانشگاه علوم پزشکی بوشهر آخرین رتبه را در رتبه بندی براساس «شاخص مستقل» از مقیاس کسب نموده اند. با مطالعه رابطه غیرخطی (Power-law) میان تولیدات علمی و استنادات، وجود اثر متیو در اعتباربخشی به تولیدات علمی مورد تایید قرار گرفت.

An individual who breaks a law that conscience tells him is unjust, and who willingly accepts the penalty of imprisonment in order to arouse the conscience of the community over its injustice, is in reality expressing the highest respect for the law. Martin Luther King, Jr. Abstract The following paper will present the theory and possibilities of implication of the phenomenon of civil disobedience understood as one of the most powerful and most effective tools of democratic society when it comes to implementing the necessary and indispensable changes required for the improvement of the political domain and the social public sphere. In the first part I will present the narrow but orthodox and widely discussed definition of civil disobedience presented by John Rawls in his Theory of Justice (1971). Given such a definition, as well as the major conditions under which the actions undertaken in the name of civil disobedience can be justified, I will focus my analysis on two major aspects of the discussed notion. Firstly, I will discuss civil disobedience, which is in its essense an unlawful act, paradoxically expresses the highest respect for the positive law by the person performing the civilly disobedient act through one’s submission to the judgment of the law which is an object of one’s protest. This way, civil disobedience presents itself as the phenomenon which, not having a legal recognition (not being legalized), holds super-legal force required to impose the changes on the unjust legal system or on the particular unjust regulation. Secondly, I will point out that civil disobedience, as a public act performed by the people (the subjects of the particular law), expresses the will of the people and, therefore, it can not be used (by themselves) in the ways contradictory to their best self-interest but always supported by the “the commonly shared sense of justice” (Rawls). From this premise I conclude that the universal human rights, as thier supporters claim, are one of the main ends of the political activism in the recent decade and should be advocated in the civilly disobedient manner. In the last part I will contrast the Rawlsean definition with a much broader and more relevant understanding of civil disobedience when it concerns today’s globalizing world. In this world, the nation-states cease to be the only political actors when confronted with the transnational public sphere, and, therefore, the understanding of civil disobedience as a transversal arena of public dissent presented by Roland Bleiker (2000) is more appropriate. In this definition civil disobedience becomes, not only a political instrument of particular subjects of a particular society, but it also becomes a tool for the international mobilization of means and of people in the name of presenting and imposing the respect for the universal human rights despite the national borders and societal paradigms.

Western discussions of human rights have led to the coalescence of two distinct positions regarding the fundamental, inalienable liberties that citizens should be able to enjoy as a matter of principle. The first, commonly known as the cosmopolitan perspective , asserts that one set of basic human rights is valid for all societies. The other claims that citizens of different societies may possess different sets of human rights, albeit ones that any thoughtful person would acknowledge to be essentially decent and appropriate to the cultural and historical circumstances of the community at hand. Among a great many prominent cosmopolitan theorists, David Held stands out as the most consistent and vociferous champion of a universalist conception of human rights. Arguably the most influential proponent of distinct packages of rights for various social milieux is John Rawls, whose controversial notion of the Law of Peoples explicitly calls on liberal societies to tolerate, if not actually respect, alternative ways in which a minimal cluster of basic rights might be articulated. This paper demonstrates first that these two, generally opposed poles of the debate over human rights have moved much closer to one another than one might expect.

The development of digital technology encourages the advantages of using digital media as the main information source. However, such development has also been misused by certain individuals or entities to mislead the public by generating fake news. On the Internet, false information travels faster than the truth, and it takes a lot of effort to stop it. This article uses a qualitative approach analysis to evaluate the various strategies used to thwart false news. In the first part, the authors described the notion of false news. In the second part, the authors examined the legislative framework that Malaysian parliaments have adopted to make it illegal to spread and publish false information. In the final part, the authors zoomed through the lens of jurisprudence that can be applied as a counter measure against dissemination of fake news. Hence, the importance of this article is to provide a clear understanding of the jurisprudence analysis of fake news in Malaysia.

Regarding the importance of environment in material and spiritual lives of nations, preservation of the environment and preventing the acts taking place against the environment are of great importance for each person, community and country. Thus, in order to explain and clarify this important right, the present research the philosophy of s and its effects. By philosophy of laws it is meant the general theory governing the law and sometimes it is referred to as generalities of the law whose subject is discussing the logical relation among the existing rules. But, two important things are involved in law philosophy: the basis of the law and its purpose. Regarding the basis of the law, there are some disagreements among the learned men of this skill and also there are some disagreements concerning the question “ Is originality individual, community and government, or combination of the two, and this disagreement lead to different results in practice one of which is discussion about philosophy of s and depending on its nature (philosophy of s, materialistic or divine point of view) it leads to double-edged results. Thus, discussion about philosophy of s is a basic discussion that requires to be studied before the long discussions about environment laws. In short, it can be said: According to theologians, philosophy of defending the environment is having knowledge of obligation in preservation of (common heritage of human being) the environment and this philosophy, according to materialists, is profit seeking (as much as possible) and if they talk about environment, it’s because they want to enjoy more profits in long-term. But, alas! Modern materialist individual who , for the purpose of gaining the land, turns his face away from the heaven, should know that he will lose the land just because of lacking the heaven and it is clear that difference in philosophic point of view, will also have different consequences. Steps related with environment and dealing with environment pollution and destruction of environment, like most of social issues, is far from legal issues and leads to different legal aspects.

The advent of advanced artificial intelligence (AI) technology, represented by ChatGPT, has ushered in new possibilities in the realm of language learning and teaching. This pre-application pedagogic position study delves into the potential benefits and associated challenges of employing ChatGPT as a potent pedagogical instrument for the acquisition of legal vocabulary. The proposed pedagogy is based on the authors’ primary experiences with the use of ChatGPT for their personal and pedagogical purposes and an unsystematic application of the pedagogy in EAP classes for undergraduate students at a law school of a university in Bangladesh. Our pre-application proposed innovative ChatGPT-mediated approach to vocabulary instruction is theoretically grounded in constructivism in language teaching and (web) technology in constructivist language pedagogy. The proposed pedagogy utilizes online newspapers with legal terminology, creating an interactive learning environment that encourages active participation and covers pronunciation, meaning, and spelling. It leverages primary language word definitions, refines pronunciation, fosters bilingual comprehension, and enhances spelling proficiency, offering a comprehensive learning experience. However, the study also predicts that the implementation of ChatGPT-based language instruction may involve challenges related to educator proficiency, student participation, resource limitations, and technology requirements. This study not only underscores the value of ChatGPT in language education but also paves the way for future research and innovation in the field.
Evaluating the Challenges of the Islamic Republic of Iran in Achieving Political Justice in the Legal Sphere(مقاله علمی وزارت علوم)

The fulfilling of justice and hence political justice as the primary goal of the Islamic Republic of Iran faces challenges as it is perceived as a significant obstacle to achieving this goal and, on the other hand, poses a threat to the efficiency of the system. Therefore, the present study focuses on the topic of law in response to the main question: ‘What challenges does the Islamic Republic of Iran face in achieving political justice in the legal sphere?’ By utilizing the conceptual framework of political justice and employing a descriptive-analytical method, the research aims to evaluate the progressive challenges of the Islamic Republic based on the current status of political justice. The findings indicated that while the conditions for equality at the level of legislation are relatively favorable, the elements of equality are not well realized at the levels of implementation and monitoring. The failure to apply and promote the element of competence in law-making is considered a barrier to achieving political justice.
