Theoretical Aspects of Justice in the Precept of Prophet of Islam

The present article is an attempt to study theoretical aspects of justice in the precept of the holy Prophet of Islam, by focusing on practical and objective results. In the first place, the necessity and significance of political justice has been explained in three parts. In the next step, the nature, levels and foundation of justice in the viewpoint of the holy Prophet are discussed. For purpose of this study, equality is considered as the foundation of justice in human societies. Finally, the main indexes of justice and signs of justice are elaborated. In this paper, political justice in the viewpoint of the holy Prophet has two foundations, three levels, a starting point and one main index. The foundations of justice are reason; levels of justice are the universal system of being, society and human beings. The starting point of justice is the power center at any level of political system and naturally the higher levels are more important. Human beings, on the basis of their four important characteristics and their generalization at the level of political system, which is in charge of realization of justice, achieve two results pertaining to method of justice and objective of justice. These two results prepare the grounds for the society to get close to justice. These two results are lack of extremism and welfare and relief which are congruent with the ultimate objective of justice, i.e., happiness and felicity of human beings in the world and the hereafter.

Sociopolitical Justice in Three Jurisprdential, Philosophical and Sociological Approaches

Justice has been reflected upon by various religious and nonreligious thinkers since ancient times. In Islam, discussions of justice among theologians started in different sects with a discussion of divine justice and gradually expanded to reach discussions of social and political justice. While examining the various aspects of sociopolitical justice in Islam, this article makes an attempt to follow this concept in three jurisprudential, philosophical and sociological approaches among contemporary Muslim thinkers. In this respect, the views of three thinkers, who paid attention to this concept in their works, is of significance. To this end, the views of Allâmé Mirzâ Hoseyn Nâini will be discussed from the Islamic jurisprudential point of view, those of Ayatollah Mortezâ Motahari from the philosophical point of view and those of Dr. Ali Shariati from the sociological point of view. This study will also make an attempt to establish landmarks in the discussion of justice, with which the reader can make a comparative study. For this purpose, the philosophical, social and sociological foundations of justice will be emphasized and various aspects of justice (political, social, economic and philosophical justice) will be identified and introduced accordingly.

This article mainly undertakes to discuss theoretical aspects in the Noble Prophet's political conduct. In this article, firstly the necessity and importance of political justice has been explained in three parts. Thereafter, we have undertaken to define the essence of justice and to discuss its levels and principles in the Noble Prophet's thought. Equality, as the most important principle of justice in human societies, has also been dealt with. The final discussion focuses on two standards of justice, namely "the syndrome of justice" and "the main criterion of justice". In this discussion political justice from the viewpoint of the Noble Prophet (s) has two principles, three levels, one beginning point and one cardinal standard. The principles of justice are reason and equality, and the levels of justice are the system of being, society and Human being. The beginning point of justice is the epicenter of power at every level of the political system and naturally higher levels have more importance, and the main standard of justice is an indisputable Islamic principle, namely "do unto others what you would like them do unto you". In political justice, "the method of justice" and "the goal of justice" bring society close to the actualization of justice, and avoiding extreme ends is compatible with ease and tranquility, both of which are the ultimate goals of justice, namely Human's felicity and happiness in the world and the Hereafter.

Evaluating the Challenges of the Islamic Republic of Iran in Achieving Political Justice in the Legal Sphere(مقاله علمی وزارت علوم)

The fulfilling of justice and hence political justice as the primary goal of the Islamic Republic of Iran faces challenges as it is perceived as a significant obstacle to achieving this goal and, on the other hand, poses a threat to the efficiency of the system. Therefore, the present study focuses on the topic of law in response to the main question: ‘What challenges does the Islamic Republic of Iran face in achieving political justice in the legal sphere?’ By utilizing the conceptual framework of political justice and employing a descriptive-analytical method, the research aims to evaluate the progressive challenges of the Islamic Republic based on the current status of political justice. The findings indicated that while the conditions for equality at the level of legislation are relatively favorable, the elements of equality are not well realized at the levels of implementation and monitoring. The failure to apply and promote the element of competence in law-making is considered a barrier to achieving political justice.
