چکیده
دولت جمهوری اسلامی ایران به عنوان یکی از اعضای سازمان ملل متحد و امضاکننده اعلامیه جهانی حقوق بشر و میثاق بین المللی حقوق مدنی و سیاسی و نیز اعلامیه اسلامی حقوق بشر، اجرای تکالیفی را برعهده گرفته و موظف است که تمامی امکانات و تواناییهای خویش را در جهت ایجاد زمینه مساعد برای تحقق اهداف و آرمانهای مذکور در اسناد حقوق بشری به کار گیرد. در این میان نیروهای انتظامی و پلیس به دلیل تعامل پیوسته و مستقیم با شهروندان و نقش انکارناپذیرشان در فرایند دادرسیهای کیفری، نقش بسزایی در دستیابی به این اهداف دارند. در این مقاله پس از مرور عدالت و حقوق بشر در شئون حکومت و مردم و نظریات و پژوهشهای موجود در این زمینه، الزامات پلیس در زمینه حقوق و آزادیهای شهروندان، شامل رعایت عملی فرض بی گناهی متهمان، عدم مداخله در حریم خصوصی افراد، رعایت قانونی بودن توقیف، تضمین انسانی بودن اوضاع بازداشتگاه، رعایت روشهای قانونی در بازجویی، ممنوع بودن شکنجه و رعایت روشهای قانونی در جمع آوری مدارک به تفصیل مورد بررسی قرار گرفته است. با جمعبندی موارد مطرح شده و با توجه به اوضاع خاص کنونی کشور به نظر می رسد که یکی از مهمترین اولویتها در خصوص جلوگیری از نقض قواعد و اصول حقوق بشر، اقدام در جهت آموزش افراد جامعه نسبت به حقوق حقه خویش در فرایند دادرسی است.The police human rights necessities on citizen's rights and liberties
Islamic Republic of Iran government as one of the members of United Nations and International Protocol of Human Rights and International Treatment of Civilian and Political Rights and also the Islamic Intimation of Human Rights, is responsible for doing some tasks and must apply all the facilities and potentials to provide a suitable ground, for achieving the goals and objectives mentioned on human rights documents. In such situation the law enforcement has a critical role to achieve these goals and objectives because of persistent and direct interactions with citizens and their undoubted role in criminal justice. In this paper, after reviewing the justice and human rights in government tasks and citizens and opinions and available researches on this field, police necessities on rights and liberties of citizens including: the practical commitment to innocence of culprits, not interfere with citizen's privacy, guaranteeing the suitable condition of concentration camp, following the rules of inspection, forbidding the torture, following the rules of gathering documents have been thoroughly investigated. After reviewing the mentioned problems and according to specific conditions of country it seems that one of the most important priorities involving the prevention of breaking the human rights is training the members of society to defend their rights in trials.
