چکیده
طراحی مدلی در توصیف کیفری اختصاصی که بتوان آن را به عنوان الگویی در تحلیل و نقد توصیف های کیفری به کار گرفت، بسیار بااهمیت تلقی می شود، چراکه این امر موجب درک صحیح توصیف ها و ارتقای مهارت های توصیف می گردد و در طولانی مدت منجر به ایجاد رویه ای هماهنگ شده در نظام حقوقی می شود که امنیت قضایی و کاهش اختلاف درجه توصیف میان مجامع علمی حقوقی و سیستم قضایی را در پی دارد. بدین منظور مدلی در توصیف کیفری اختصاصی پیشنهاد گردیده و اجزای آن به همراه نمونه ای از قانون مجازات اخلال گران در نظام اقتصادی کشور موردِتحلیل قرار می گیرد. در این مدل نخست انواع توصیف کیفری، مبنا و قلمرو آن به عنوان مقدمات ورود به مدل مذکور موردتوجه قرار گرفته و سپس ارکان تشکیل دهنده توصیف کیفری اختصاصی یعنی عنصر قانونی، مادی و روانی و اجزای هریک از آنها با لحاظ مدل پیشنهادی تشریح می شوند. مجازات نیز به عنوان یکی از اجزای لاینفک توصیف کیفری اختصاصی در بحث نهایی مطرح می گردد. در تبیین اجزای مدل توصیف کیفری، تحلیل بند الف ماده 1 قانون فوق الذکر درجهت روشن نمودن مباحث و تسهیل درک این مدل و اجرای آن در توصیف های کیفری اختصاصی می تواند مؤثر باشد.Explaining Specific Criminal Description Model: to look to Paragraph 1 of Article 1 of the Punishment Law of Disruptors in the Economic System
Designing a model in specific criminal description that can be used for analyzing and criticizing punitive descriptions is very important, because this will allow us to properly understand the descriptions and enhance the skills of description, also in the long time it leads to the establishment of a coordinated procedure in the legal system which seeks to judicial security and reduction the degree of difference between academic literature and judicial systems. For this purpose, a model was proposed in specific criminal description and its detail are analyzed with a sample of the punishment law of disruptors in the economic system. First, in this model, the types of criminal description, its basis and scope are considered as the preconditions for entering the model. Then, elements of specific criminal description, legal, material and mental elements and their detail, are described with regard to the proposed model. Also punishment as integral part of specific criminal description is considered in the final discussion. In explaining criminal description model, analysis of paragraph 1 of article 1 of The Punishment Law of Disruptors in the Economic System can be effective to clarify the issues and facilitate understanding of this model and performing it in specific criminal description.
