چکیده
نظریه تفکیک قوا به عنوان یکی از نظریه های قدیمی موجود مباحث حقوق اساسی، امروزه با چالش ها و ناکارآمدی های بسیاری در عرصه عمل مواجه گردیده است. تا جایی که برخی از مخالفین تندرو سخن از زوال این نظریه به میان آورده اند. در این مقاله با رویکردی نوین از تفکیک قوا که چهره آن را به واقع دگرگون نموده است، در جهت ارائه راهکار برای این چالش ها تلاش گردیده است. این مقاله در واقع چهره جدیدی از تفکیک قدرت را به ما ارائه می نماید که در آن در عوض تمرکز تفکیک ساختاری قدرت در دستان قوه مجزای حکومتی به شناخت مراکز قدرت مدرن و تمرکز تفکیک بر کارکردهای قدرت پرداخته شده است و از این طریق به حل چالش ها برای گنجاندن ساختار حکومت های مدرن در چهارچوب تفکیک سنتی و ساختاری قوا پاسخ داده شده است.Transformation of the Meaning of the Theory of Separation of Powers to the Functional Concept
As one of the existing theories of the constitutional law, the separation of power is facing great challenges and lack of functionality in its application, to the extent that some of the radical opponents of this theory consider it obsolete.<br />The present article aims at transforming this view, by way of providing a modern approach to this theory, and attempts to put forward a method for facing such challenges. Rather than the formal separation of power, this article concentrates on the functional separation, which is a new approach to the separation of power.<br />This approach, concentrates on separation of power functions, rather than power structures, whereby dealing with challenges in the separation of power.
