چکیده
سازمان های بین المللی در طول حیات خود با وضعیت های مختلفی مواجه می گردند. یکی از مهم ترین فصل های زندگی این سازمان ها دوره انحلال و پایان یافتن شخصیت حقوقی بین المللی آنها است. نقش معاهده به عنوان اساسنامه در ادامه حیات آنها و نقش دولت ها در تأسیس آنها از یکسو و استقلال و شخصیت بین المللی آنها از سوی دیگر باعث اختلاف نظر در خصوص مبنای انحلال سازمان های بین المللی گشته است. از سویی انحلال سازمان های بین المللی را ناشی از اراده دولت ها دانسته اند، و از سویی دیگر اراده خود سازمان ها را عامل آن تلقی دانسته اند. در این مقاله سعی شده است، با توجه به ماهیت سازمان های بین المللی و شیوه های انحلال آنها، مبنای جامعی از انحلال نمایان شود.Reflections on Dissolution of International Organizations
There are many situations that International Organizations confront with during their existence. Dissolution of IOs and termination of their international legal personality is considered to be one of the most important parts of their lives. The role of establishing treaties in the continuance of IOs’ life as their constitution beside the role of States in their creation on one hand, and the autonomy and international legal personality of IOs on the other, has raised different approaches on the basis of dissolution of IOs. <br />Some has come to the conclusion that the will of States is the base of dissolution of IOs, while others believe IOs are the only competent power to dissolve themselves. In this article we have tried to reach a thorough conclusion on the issue considering the nature of IOs and the methods available for their dissolution.
