مطالعه و بررسی نهادهای کیفری سنتی ایرانی در قوم بختیاری

چکیده
پژوهش حاضر به صورت کتابخانه ای با کنکاش در کتب و مقالات مختلف در حوزه فرهنگ و تاریخ ایل بختیاری به شناسایی و بررسی مجازات کیفری سنتی ایرانی در قوم بختیاری از جمله خونبس، خون و چوب، سوگند، خون و کالات و تقاص پرداخته است. با توجه به اینکه منشأ این نهادها عرف و ساختار جامعه همگرای بختیاری است و به دلیل آن که هنوز شاکله اصلی این جامعه همبسته به قوت خود باقی است، به نظر می رسد که احیاء و اصلاح هر کدام از این نهادها بر اساس نیاز جامعه می تواند گام مؤثری در راستای اهداف عدالت ترمیمی باشد.A Study of Iranian Traditional Disciplinary Organizations among Bakhtiari People
Following a library method and through a thorough study of various books and papers in the field of the history and culture of Bakhtiari people, the present paper aims to identify and explore some of the Iranian traditional disciplinary acts of Bakhtiari tribe, such as Xun bas (renouncing gore), blood and wood, oath, Xun and Kalat (blood money), and atonement. Since the origin of such punishments is the structure and conventions of the converged Bakhtiari society, and since the main foundations and forms of this united society are as strong as they were before, it seems that the revivaland modification of each of such criminal punishments based on societal needs could be a useful step towards attaining the goals of restorative justice.
