چکیده
یکی از مسائلی که ممکن است به اساس خانواده خلل وارد کند، اشتغال زن و شوهر به مشاغلی است که به بنیان و اساس خانواده آسیب می رساند. سؤال اصلی، محدوده اشتغال زوجه و اختیار زوج در ایجاد محدودیت برای حفظ اساس خانواده در حقوق ایران است. مقاله با روش کتابخانه ای نگاشته شده و با تأکید بر حق اشتغال زوجه به حکم اولیه، در مواردی به شوهر اجازه داده شده است که چنانچه اصل اشتغال زوجه یا نوع آن به اساس خانواده خللی وارد کند، بتواند زوجه را از آن نوع خاص شغل یا اصل اشتغال منع کند. این اختیار را می توان در راستای اختیارات مرد، به عنوان عنصر قوام بخش خانواده، تحلیل کرد. از موارد مجاز منع اشتغال زوجه، اموری است که به وظیفه زن در تشیید مبانی خانواده، مساعدت در تربیت فرزندان و انجام وظیفه تمکین خلل وارد کند یا حیثیت و شئون خانوادگی را خدشه دار نماید. نکته درخور تأکید اینکه برای جلوگیری از سوء استفاده احتمالی شوهر از اعمال این حق، تقاضای زوج و اثبات تنافی شغل انتخابی با مصالح خانواده یا حیثیت مرد یا زن و صدور حکم قضایی، لازمه جلوگیری از اشتغال زن به حرفه مغایر با وظایف و شئون خانوادگی است.Husband’s authority in prohibition of wife’s employment in the Iranian legal system
