چکیده
از جمله موارد اختلافی اقسام بیع میان فقهای امامیه، بیع معاطاتی است لذا تحقیق در مورد ادله صحت بیع معاطات از منظر فقه امامیه لازم و ضروری است بنا بر این هدف اصلی این تحقیق صحت بیع معاطات از منظر فقه امامیه با تأکید بر آراء امام خمینی است که به صورت تبیین تشریح، توصیف و تحلیل، به این موضوع پرداخته شده است که عده ای از فقها، معاطات را بیعی متزلزل می دانند، مثل علامه حلی و محقق حلی و برای اثبات ادعای خود دلیل هایی ذکر کرده اند. مثل روایت، اصل و اجماع. اما عده ای از فقها از جمله امام خمینی معاطات را صحیح و آن را لازم می دانند و برای اثبات ادعای خود ادله ای ذکر کرده اند و نظریه کسانی که بیع معاطات را لازم و صحیح نمی دانند را رد می کند . بنابراین شروطی که در بیع لازم است و همچنین تمام خیارات ، در بیع معاطات به قوت خود موجود می باشند.Evidence for the validity of the sale of concessions from the perspective of Imami jurisprudence with emphasis on the views of Imam Khomeini

However, some jurists, including Imam Khomeini, consider the concessions to be valid and necessary, and have cited arguments to prove their claim, and reject the theory of those who do not consider the sale of conces sions necess ary and correct. Therefore, the conditions that are nece ssary in the sale, as well as all the options, are prese nt in the sale of conces sions.
