تأثیرگذاری طبقات ورّاث در تحقق عول؛ مطالعه تطبیقی فقه مذاهب اسلامی

چکیده
عول که کاستن از سهم الارث ورّاث و افزایش تعداد سهام جهت تأمین سهام همه وراث می باشد، راه حلی از جانب فقها در زمان اجتماع حقوقِ ارثیِ ورثه بر ترکه متوفی است، هنگامی که مال به تمام سهم الارث افراد وفا نکند و امکان اسقاط و محروم ساختن ورثه هم نباشد. فقها درباره این مسأله دو دیدگاه موافق و مخالف مطرح نموده اند و مخالفان با رد عول به دلیل مخالفت با آموزه های فقهی، نقص در سهام ترکه ی صنف به خصوصی از صاحبان سهم (ورّاث) را به عنوان راهکار قرار داده اند؛ در حالی که این راه حل هم با مشکلات عدیده ای روبرو است. در این پژوهش که با استفاده از روش توصیفی تحلیلی و با استناد به منابع کتابخانه ای انجام شده است، پس از بررسی و تحلیل سهم الإرث اصناف سه گانه ی برادران و خواهران در قرآن کریم، می توان به این نتیجه رسید که اگر صنف قوی تر بر صنف ضعیف تر مقدم گردد و به عنوان قاعده ای در اعطای سهم به ورثه قرار داده شود، توسل به عول را منتفی می نماید و راه برون رفتی برای حل مشکلات و تعارضات پیش آمده در نظریه مخالفان نیز خواهد بود.The influence of heirs classes in fulfilment of the A'oul (shares’ reduction of heirs); A comparative study of jurisprudence of islamic sects
Oul, that is decreasing the inheritance share (sahmolerth) of heirs (worrath) and increasing the number of shares to provide the share for all heirs, is a soloution by jurisconsult (Foqaha) when ejtema of inheritance rights of heirs is on remained bequest (tarake) of the begone, and the assets could not provide peoples inheritance share while there is no way to esqat or deprive the heirs. Foqaha announced two opposite viewpoints for the problem where the opponents reject the Oul for contradicting Fiqhi principles and present Naqs(decrese) in the assets shares of a particular group of share owners as a solution. this idea also faces various problems. This research using description and analysis by refering to library sources analyzes the inheritance share of triple groups of brothers and sisters in Qoran kareem and concludes; while the stronger guild gets priority over the weaker one and it becomes a base for giving shares to inherit-ants, it contradicts using Oul and presents a solution for resolve the problems and disagreements in opponents view.
