واکاوی تحول قضایی و پیشگیری از فساد اقتصادی (گام دوم انقلاب)

چکیده
فساد از جمله پدیده های سازمانی است که روند توسعه دولت ها را دچار بحران می نماید. فساد اقتصادی، گرایش به تمرکز ثروت دارد، وقوع دیگر جرائم را تسهیل نموده این مفاسد در شرایط تحریم و جنگ اقتصادی شدت می یابد. سند تحول قضایی شامل ۳۷ ماده در مورخ 30/9/1399 به تصویب رئیس قوه قضاییه رسید، که در آن چالش ها و راهبردهایی را بیان کرده، یکی از پایه های اصلی، بازگشت دستگاه قضایی به مأموریت های اصلی اشاره شده در قانون اساسی، که مهم ترین آن پیشگیری از جرم و فساد است، می باشد. رهبر معظم انقلاب اولویتِ مبارزه با فساد را از درون قوه قضاییه می دانند؛ بیانیه گام دوم انقلاب اسلامی، در تاریخ 22/11/1397 توصیه هایی را در هفت محور بیان نمود که محورهای سوم و چهارم به مباحث اقتصاد؛ مبارزه با فساد اختصاص دارد؛ در این پژوهش سؤال این است که نقش و تأثیر سند تحول قضایی در پیشگیری از فساد اقتصادی چگونه است؟ راهکارها و راهبردهای مبارزه با فساد اقتصادی در گام دوم انقلاب چه می باشد؟ روش انجام، پژوهش از نوع توصیفی-تحلیلی بوده و برای گردآوری داده ها از روش کتابخانه ای و اسنادی استفاده شده است. سند تحول قضایی به عنوان یک سند بالادستی قضایی با استفاده از ظرفیت های قانونی و توجه به عدالت و پرهیز از تبعیض بین افراد در برخورد و مجازات با مفسدان، می تواند در کاهش فساد اقتصادی بسیار مؤثر باشد. یافته های پژوهش نشان می دهد راهکارها و راهبردهای قابل تصور در راستای پیشگیری، عبارت اند از: الف) شفافیت در اعلام دارایی های مسئولین، ب) برخوردقاطع و متقن با مفسدان و مجرمان اقتصادی، ت-تقویت و افزایش دادگاه های ویژه اقتصادی ث) بهره گیری از قضات مجرب، متخصص... ج) رسیدگی قاطع و سریع.متن
Factors of Corruption and its Prevention with an Approach to the Second Step Statement of the Revolution and the Judicial Transformation Document
Corruption is one of the organizational phenomena that causes a crisis in the development process of governments. Economic corruption tends to concentrate wealth, facilitate other crimes, and intensify in the face of sanctions and economic warfare.The ۳۷-article Judicial Transformation Document was approved by the Head of the Judiciary on ۲۰/۱۲/۲۰۲۰, in which he stated the challenges and strategies, one of the main foundations of the return of the judiciary to the main mission mentioned in the Constitution, the most important of which is crime and corruption prevention. The Supreme Leader of the Revolution considers the priority of fighting corruption to be from within the judiciary. The statement of the second step of the Islamic revolution, on ۲۲/۱۱/۲۰۱۷, made recommendations in seven axes, the third and fourth axes to economic issues; In this research, the question is, what is the role and effect of the judicial reform document in preventing economic corruption? What are the solutions and strategies to fight economic corruption in the second step of the revolution? The method of carrying out the research is descriptive and analytical, and library and document methods were used to collect the data. Corruptors can be very effective in reducing economic corruption. The findings of the research show that the conceivable solutions and strategies in the direction of prevention are: a. Transparency in declaring the assets of those in charge, b. Decisive and firm dealing with corruptors and economic criminals, d. Strengthening and increasing special economic courts, and e. Using the experienced expert judges.
