چکیده
در حال حاضر بیماری کرونا که ناشی از ویروسی نوظهور و واگیردار است، در حال افزایش بوده و باعث مرگ تعداد قابل توجهی از افراد شده است. در این میان، تحلیل رفتار فرد ناقل و بررسی مسئولیت وی مدت هاست مورد توجه دولت ها، جوامع، رسانه ها و حقوقدانان است. آنچه که به این توجه دامن می زند عوارض سنگین انتقال ویروس و نبود راه درمان مشخص است. به خاطر همین عوارض، سیاستمداران در کشورهای مختلف بر آن هستند تا با برخوردهای قهری و سختگیرانه جلوی پیشرفت این پاندمی را بگیرند، که یکی از اقدامات مؤثر، واکنش کیفری در مقابله با ناقلین کرونا می باشد، که برای نیل به این مقصود توجه به رفتار فرد ناقل و تحلیل آن و در نهایت تطبیق آن با قوانین کیفری موجود، جهت اقدام به هنگام ضروری می نماید. در این مقاله سعی بر تعیین مسئولیت فرد در صورت انتقال ویروس کرونا بوده و با بررسی جرایم مختلف در این حوزه سعی بر ارائه دیدگاهی مبسوط در تحلیل رفتار و پیامدهای آن در اثر انتقال ویروس خواهد بود. البته در این میان توجه به ویژگی های ویروس به ویژه کشنده بودن آن نیز، جای دقت دارد، که سعی خواهد شد، به تناسب به آن ها پرداخته شود.Examining Criminal Behaviour Resulting from the Transmission of Coronavirus
Coronavirus disease that results from an emerging infectious virus has increased significantly and brought many lives to the death. Accordingly, analysis of the behavior of the carrier of the disease and his/her responsibilities has attracted the attention of states, communities, media, and lawyers because the transmission of the virus has serious consequences and definitive treatment is lacking. Therefore, politicians in different countries try to prevent the spread of the pandemic through forced encounters and strict measures such as penal actions. To this aim, consideration of the intent of the carrier, analysis of his behavior, and matching it with penal law is necessary. The current research is an attempt to examine the responsibility of the transmitter and compare it with other similar crimes to arrive at a comprehensive view for analyzing the behavior of the carrier and the consequences associated with it. Some notable characteristics of the virus such as fatality are also considered.
