بررسی تطبیقی اعلامیه بین المللی حقوق بشر با تعالیم قرآنی (مقاله علمی وزارت علوم)

چکیده
منشور جهانی حقوق بشر که به انگیزه حاکمیت عدالت و صلح جهانی تدوین شده و در ایجاد صلح و امنیت نیز کارایی داشته، بر پایه مبانی و مبادی خاصی استوار است. در این پژوهش حاضر ضمن بررسی مواد و مفاد سی گانه این اعلامیه و تطبیق آن با دیدگاه قرآن کریم از لحاظ نظریه پردازی و تطبیق و اجرا با استناد به آیات و روایات و کتب معتبر دینی و حقوقی مورد بررسی قرار گیرد. محور تعیین مهمترین اصول حقوق و آزادی های بشر از جمله اصل آزادی، اصل برابری و مساوات که در اعلامیه حقوق بشر قرار گرفته و با تعالیم دین مبین اسلام ظاهراً همخوانی دارد اما از سنخیت کافی برخوردار نمی باشد. على رغم جهانی بودن اعلامیه حقوق بشر، اما تاکنون چالش های بسیاری را در میان برخی ملل جهان و از جمله کشورهای مسلمان را برانگیخت که نادیده گرفتن مبنای اصلی حقوق بشر در اسلام یعنی یگانگی و وحدانیت خداوند و اکتفا نمودن به عقل بشری و نیز محور بودن انسان در تدوین این، اعلامیه دخالت داشته است. نتیجه کلی این پژوهش بررسی وجوه مشترک و نکات محل اختلاف مواد اعلامیه حقوق بشر با دیدگاه های قرآن کریم از لحاظ محتوی و مضمون در حیطه های زیر مورد مقایسه گرفت از جمله؛ کرامت انسانی، مبانی، دیدگاه ها، انواع آزادی ها، مالکیت، تفاوت در اجرا، تساوی ذاتی و اصل برابری، حق حیات و امنیت در زندگی شخصی، تفاوت در نوع نگرش به انسان، غفلت از رابطه انسان با خداوند، رفع چالشها و کاستی های حقوق بشر.A comparative study of the International Declaration of Human Rights with Quranic teachings
The Universal Charter of Human Rights, which was compiled with the motivation of the rule of justice and world peace and was effective creating peace and security, is based on certain principlespresent research, while examining materials and contents declaration and its adaptation to the perspective of the Holy Quran, in terms theorizing, applying and implementing, it should be examined by referring verses and traditions and authentic religious and legal books. The axis determining the most important principles of human rights and freedoms, including the principle of freedom, the principle equality, which is included the declaration of human rights and is apparently ine with the teachings of the Islamic religion, but does not have sufficient validity.
Despite the universality of the Declaration of Human Rights, it has so far provoked many challenges among some nations of the world, including Muslim countries, which ignore the main basis of human rights in Islam, which isoneness of God and the reliance human reason and the axis Being human has been involved in compiling this declaration. The general result this research was examine common points and points difference between the articles Declaration of Human Rights and the views of the Holy Qur'an in terms of content and theme following areas, such as; Human dignity, foundations, views, types of freedoms, property, differences implementation, inherent equality and the principle of equality, right life and security in personal life, differences type of attitude towards humans, neglecting the relationship between humans and God, solving challenges and shortcomings Human rights.
