چکیده
بررسی چالش های موجود در قانون بکارگیری سلاح توسط ماموران نیروی انتظامی در حین انجام ماموریت موجب حق تیراندازی داشتن مامورین در تخریب اموال عمومی و دولتی است این امر شامل تخریب اموال شخصی نمی باشد مأمورین برابر ضوابط قانونی حق بکارگیری سلاح و تیراندازی دارند و تیراندازی به منظور استقرار نظم و امنیت و توقیف وسایل نقلیه و توقف زندانیان متواری با شرایطی برای مأمورین مجاز شناخته شده است در این مقاله مورد بررسی قرار گرفته است هدف از انجام این تحقیق، تبیین چالش ها و ضوابط و مقررات استفاده از سلاح و تیراندازی توسط مامورین نیروی انتظامی در حین انجام وظیفه می باشد این پژوهش با روش کتابخانه ای به انجام رسیده است نتایج پژوهش نشان می دهد، در نظام حقوق کیفری ایران به منظور حفظ نظم و امنیت، قوانین و مقرراتی در خصوص برخورد با اخلال گران در نظم و امنیت وضع گردیده و نحوه استفاده از سلاح برای مامورین مشخص است ولی در خصوص تعیین مسئولیت، دقیقآ چارچوب دقیق و مشخصی وجود ندارد و محاکم با توجه به کیفیت هر پرونده اتخاذ تصمیم می نمایندکه این امر موجب به چالش کشیده شدن ماموران در مقابله با افراد بزهکار در ماموریت های میدانی شده است تیراندازی به دو دسته قانونی و غیر قانونی تقسیم نموده است. چنانچه تیراندازی پلیس، قانونی شناخته شود، مأمور تیرانداز هیچ مسئولیتی ندارد اما اگر تیراندازی غیر مجاز شناخته شود، یا متوفی یا مجروح بی گناه باشد، مأمور تیرانداز نیروی انتظامی مسئولیت دارد و طبق قانون باید با وی رفتار شود.Examining the challenges of using weapons in NAGA field missions in dealing with criminals
Examining the challenges in the law on the use of weapons by law enforcement officers during their mission gives the officers the right to shoot in the destruction of public and government property, this does not include the destruction of personal property. Establishing order and security, impounding vehicles, and arresting escaped prisoners are permitted under certain conditions for officers. In this article, the purpose of this research is to explain the challenges and rules and regulations of using weapons and shooting by police officers. It is during the performance of duty. This research has been carried out with a library method. The results of the research show that in the criminal law system of Iran, in order to maintain order and security, laws and regulations have been established regarding dealing with those who disrupt order and security. It is clear how to use weapons for the officers, but there is no precise and clear framework regarding the determination of responsibility, and the courts make decisions according to the quality of each case, which causes the officers to be challenged in dealing with criminals in the mission. In general, shooting can be divided into legal and illegal categories. If the shooting of the police is recognized as legal, the shooter has no responsibility, but if the shooting is recognized as illegal, or the deceased or injured person is innocent, the shooting officer of the police force is responsible and should be treated according to the law.
