چکیده
قاعده نفی سبیل از مهم ترین قواعد فقهی مورد استناد بسیاری از فقیهان شیعه و اهل سنت به شمار می آید که دامنه آن بسیار گسترده است، و در تفسیر و تنظیم روابط مسلمانان با غیر مسلمانان تسلط کافی را دارد. به همین دلیل تلاش برای تبیین روشن این اصل و جوانب آن مانند الزامات بین الملل بسیار حائز اهمیت است به ویژه آنکه در تلاش برای بقاء نظام و حفظ آن باشد. روش تحقیق در این پژوهش به صورت توصیفی تحلیلی می باشد، و هدف از این پژوهش بررسی الزامات بین الملل در مواجهه با قاعده نفی سبیل و تأثیرات آن بر حفظ و بقاء نظام از منظر قرآن و فقه امامیه است.Studying the International Requirements Encountering Principle of Negation of Ascendency and its Effect on Government’s Survival from Quran and Imamate’s Jurisprudence Viewpoint
Principle of negation of ascendency in jurisprudential principles cited by many Shiite and Sunnite jurisprudences and is of a wide scope; it also has sufficient mastery in interpreting and regulating the relations of Muslims with non-Muslims. Thus it is very important to try to explain the mentioned principle and its aspects such as international requirements, especially in trying to survive and preserve the government. The research method in the present research is descriptive – analytical and the purpose of the study is to investigate the international requirements encountering principle of negation of ascendency and its effects on the preservation and survival of the government from Quran and Imamate jurisprudence’s viewpoint.
