چکیده
حقوق همواره درکنار اقتصاد بوده و در اصل هم عرض با اقتصاد به حیات خود در زندگی بشر ادامه داده است. بسیاری از مفاهیم حقوقی با نگرش های اقتصادی شکل گرفته است. در همین راستا شاخه ای نوین در علم حقوق تحت عنوان تحلیل اقتصادی حقوق یا نگرش اقتصادی به حقوق ایجاد شده است. حقوق در رابطه با تجارت و اقتصاد هم نقش ایفا می کند. تجارت و اقتصاد گاها در یک مفهوم قرار داده می شوند؛ پس از تاثیر قوانین تجاری بر روی اقتصاد( بالعکس) به سادگی نمی توان گذشت. به طورکلی، امروزه جامعه بین الملل به سوی متحدالشکل کردن مقررات حقوقی با بهره گیری از نگرش اقتصادی می رود. اما نگرش اقتصادی صرف به حقوق با درنظر نگرفتن تاثیرات آن می تواند مشکلاتی را در آینده در پیش رو داشته باشد. در این مقاله درباره رابطه حقوق و اقتصاد، تاثیر نگرش اقتصادی به حقوق، اشاره ای مختصر به اهمیت تجارت و قوانین تجاری در اقتصاد و درآخر نیاز اقتصاد به یکسان سازی مقررات حقوقی در جهت رسیدن به توسعه اقتصادی واقتصاد جهانی بیان کرده است.Attitude of Legal – Economical Aspects of the Society
Law has been always beside economy and indeed continued in its existence in human’s life parallel to economy. In this sense, a new branch has been developed entitling Economical analysis of law or economic outlook. Law also plays a role in business and economy. Sometimes they get the same concept; hence, we cannot pass the influence of business laws on economy (and vice versa) easily. Generally, today’s society is going toward merging forms of legal rules using economic outlook. On the other hand, economic outlook limited to just legal aspects without considering its consequences can make troubles in future. In this study, it has discussed about the relationship between law and economy, influence of economic outlook on law, a brief hint to significance of business and business rules in economy, and finally the need of economy to merging legal rules in order to achieve economical development and the global economy.
