چکیده
یکی از عقود معین مهمی که در قانون مدنی ایران و همچنین در فقه مورد بحث و تبادل نظر حقوقدانان و فقها قرار گرفته است عقد وکالت است. با توجه به اینکه وکالت از جمله عقود اذنی است لذا اثر و مقتضایش، اعطای نیابت می باشد و از این بابت موضوع وکالت فراتر از قانون مدنی بوده و امور خاصی مانند: دلالی، حق العمل کاری، متصدی حمل ونقل و قائم مقام تجاری و وکالت دادگستری را نیز شامل می شود. لذا با این نگاه وکالت از اهمیت خاصی برخوردار است که با توجه به بررسی و تحقیقات صورت گرفته در مباحث مربوط به عقد وکالت که در قانون مدنی، 28 ماده را به خود اختصاص داده، اما در بعضی از موارد از جمله مسئولیت مدنی وکیل، نواقص، پراکندگی و خلاء قانونی وجود دارد که ممکن است در خصوص جرائم مختلف وکیل دعاوی در محاکم باعث تشتت آرا شود. لذا در این مقاله سعی شده به صورت منسجم به مسئولیت مدنی وکیل دعاوی در قبال یکی از جرائم بنام فرار مالیاتی پرداخته شود و در حد بضاعت اندک نگارنده، مسئولیت مدنی وکیل دعاوی شناسایی و معرفی گردد.Analysis of Tax Evasion Lawyers
