سایبر تروریسم و جرایم سایبری در نظام حقوق بین الملل

چکیده
رشد سریع و در عین حال نامتوازن ساختار فضای سایبری، شبکه اینترنت و فضای مجازی را به یکی از فضاهای آسیبپذیر و خطرناک تبدیل کرده است که توجه جامعه جهانی و نهادهای امنیتی، انتظامی و قضائی را بهطور نظاممند و هدفمند بهمنظور پیشگیری و مصونسازی این بستر از تهدیدهای موجود و پدیده نوظهور سایبر تروریسم را در فضای بینالمللی میطلبد. روش کار: با بررسی منابع، مقالات، کتابها، نتایج و مطالعات در حوزه جرایم سایبری، تروریسم بینالمللی و سایبر تروریسم به روش غیر آزمایشی، مقایسهای و کتابخانهای، تهدیدها و مخاطرات سایبر تروریسم و ضرورت پیشگیری از جرایم سایبری در عرصه بینالمللی مورد تحقیق و پژوهش قرار گرفته است. یافتهها: سایبر تروریسم و جرایم سایبری بسیار خطرناکتر از تروریسم کلاسیک و جرایم سنتی هستند و تهدیدهای آن برای امنیت ملی کشورها به خطری بالقوه تبدیل شده که پیشگیری، کشف و مقابله با این پدیده جرمشناختی برای نهادهای پلیسی و امنیتی بسیار پیچیده و مشکلتر از جرایم سنتی میباشد. نتیجهگیری: برنامهریزیهای جهانی و تصویب قوانین بینالمللی، افزایش همکاریهای فنی و آموزشی بینالمللی، توجه ویژه به تصویب قوانین کارآمد و بازدارنده به عنوان راهکار پیشگیری از جرایم سایبری توسط نهادهای داخلی و همکاری فی مابین سازمانهای امنیتی و پلیسی از جمله راهکارهای مبارزه با سایبر تروریسم میباشد.Cyber Terrorism and Cyber-Crimes under International Law

The cyber terrorism and cyber-crime is much more dangerous than terrorism, classical and traditional crime and threats to national security to become a potential danger that prevention detect and deal with the phenomenon of mass cognitive police and security agencies, is complex and more difficult than traditional crimes.Conclusion: global planning and approval of international law, international cooperation and technical training, Paying special attention to legislation effective and deterrent as a means of prevention of cyber-crime by domestic institutions and cooperation between police and security agencies, including strategies to combat cyber terrorism.
