چکیده
دانستن تعریف علم اصول برای تشخیص این که کدام مسئله باید در علم اصول مطرح شود، بسیار ضروری است. ازاین رو در این نوشتار، بیش از ده تعریفی که بزرگان امامیّه و اهل سنّت برای علم اصول مطرح کرده اند، با روش توصیفی تحلیلی و با ابزار گردآوری اطلاعات کتابخانه ای بررسی شده و در بوته نقد قرار گرفته اند. حاصل بررسی ها این بود که: بهترین تعریف برای علم اصول، آن تعریفی است که اوّلاً: علم اصول را صرفاً به استنباط های فقهی اختصاص ندهد، بلکه بتواند کارایی آن را در غیر از فقه مانند تفسیر و کلام سرایت دهد. ثانیاً: شامل قواعد مربوط به شبهه موضوعی نیز بشود. ثالثاً: ضابطه ای ایجاد کند تا به وسیله آن، دخول مسائل در علم اصول را بتوان تشخیص داد. رابعاً: جامع افراد و مانع اغیار باشد. بنابراین در تعریف علم اصول می گوییم: قواعدی است که بدون هیچ واسطه ای برای فهم دین اقامه می شوند یا برای فهم دین، برهان و حجت ارائه می دهند. چنین تعریفی، مسائل جزئی غیر قاعده ای یا قواعدی را که برای فهم گزاره های دینی از آنها به واسطه نیاز است و یا در راه فهم دین از آنها استفاده نمی شود، از علم اصول خارج می کند.Commandment and First Ruling on Polygamy
In Islam, permanent marriage with more than one woman (up to four women) is not prohibited and on the other hand, it is not obligatory. However, there are different opinions among the jurists regarding the fact that the first and commandment ruling (Ḥokme Awwali wa Taklifi), regardless of special conditions, is whether recommendation (Istiḥbāb), abominable (Makruh), or permissible (Mobāḥ). Although there have been many discussions and researches about polygamy; less attention has been paid to its commandment ruling (Ḥokme Taklifi) and discussions such as the philosophy of polygamy, the condition of justice, etc. have been examined more. Therefore, it is necessary to examine in detail the ruling on polygamy, which there is a great difference among jurists, and finally to answer the important question of what is the first and commandment ruling on polygamy. This article tries to answer this question by using library sources and descriptive-analytical method, and the result obtained is the recommendation of polygamy as the first ruling.
