شهروندان اراکی و پاسخگویی اداره امور عمومی در برابر قانون (مقاله علمی وزارت علوم)

چکیده
پاسخگویی ادارات دولتی به ویژه پاسخگویی آنها در برابر قانون از اهمیت بسیار زیادی برخودار است و یکی از دغدغه های همیشگی شهروندان و نمایندگان منتخب آنهاست. با این حال تحقیقات اندکی در این زمینه به ویژه در ایران انجام شده است. تحقیق حاضر با استفاده از روش تحلیل محتوای کیفی احساس شهروندان اراکی در مورد پاسخگویی اداره امور عمومی در برابر قانون را بررسی کرد. یافته های این تحقیق نشان داد که احساس شهروندان اراکی از پاسخگویی اداره امور عمومی در برابر قانون حداقل به دو دلیل ضعیف است. اول، بسیاری از شهروندان تئوری های چراغ قرمز را باور ندارند. دوم، شهروندان عادی از توانایی لازم برای گرداوری ادله و مستندات برخوردار نیستند. گرفتن وکیل و پاسخگو نگه داشتن او هم نیازمند دانش و منابع مالی است که افراد عادی فاقد آن هستند. بنابراین عملاً بسیاری از مردم عادی نمی توانند از اداره امور عمومی شکایت کنند. همچنین شهروندان نخبه اراکی احساس می کنند دیوان عدالت اداری تئوری چراغ قرمز را باور دارد و بر اساس آن به شکایت ها رسیدگی می کند. با این حال مکانیسم های این دیوان ضعیف است و نمی تواند دستگاه اداری کشور را پاسخگو نگه دارد.Arak citizens' and The Constitutional Accountability in Public Administration
The constitutional accountability in public administration is very important. And, it is one of the constant concerns of citizens and their elected representatives. However, little research has been done in this field, especially in Iran. This research investigated the feelings of Araki citizens about the constitutional accountability in public administration by using the qualitative content analysis method. The findings showed that the feeling of Arak citizens' regarding the constitutional accountability is weak for at least two reasons. First, many citizens do not believe in red light theories. Second, ordinary citizens do not have the ability to gather evidence and documents. Hiring a lawyer and holding him accountable also requires knowledge and financial resources that ordinary people lack. Therefore, many ordinary people cannot complain about public administration. Also, Araki elite citizens feel that the Administrative Court of Justice believes in the red light theory and handles complaints based on it. However, the mechanisms of this court are weak and cannot hold the country's administrative system accountable.
